The right of consumers to renege can make up for the irrational behavior of consumers,correct the market failure,and solve some problems caused by asymmetric network information.In 2019,the number of online shopping users in China has exceeded 600 million,and the total sales of online shopping have also been rising,and the national online shopping retail sales are expected to exceed 11 trillion yuan in 2019.In the face of such a huge base,China's legislation on consumer reneging power seems to be unable to deal with all kinds of problems in real life.On the basis of the new Law on the Protection of Consumer Rights and Interests,the Provisional Measures for the Seven Days of Unreasonable Return of Goods purchased on the Internet,issued in 2017,refined and perfected the right of consumers to renege,made up for the defects of consumers in information acquisition in online shopping,and balanced the position of consumers and operators in online transactions.Despite these important benefits,there are some shortcomings.For example,the time limit calculation method is not uniform,the exclusion applies the commodity scope to be vague,the consumer has the moral hazard and so on.This paper studies and compares the laws and regulations of some countries or regions with advanced legislation on consumer rights protection at home and abroad,and finds out the gaps and shortcomings of consumers' right of reneging in our country with cases,and analyzes the specific problems and puts forward some suggestions for perfection.
