| It is the foundation for the development of an e-commerce economy to strengthen the protection of online shopping consumers’ right to know.At the same time,it is also of great significance to improve the consumer rights system,enhance the government supervision,and improve the relevant legal systems.However,for the inadequacy of current protection,it is necessary to conduct an in-depth analysis.Taking the protection of online shopping consumers’ right to know as the research and reference point,this article combines China’s concrete practices to provide some effective suggestions for China’s e-commerce economic development.In addition to the introduction,the article is divided into six parts:The first part analyzes the concepts and characteristics of online shopping,and compares the right to know of online shopping and traditional shopping consumers.The differences between online shopping and traditional shopping consumers’ right to know are mainly divided into four aspects: the way to exercise the right to know is differentiated,the contents of the right to know are becoming richer,the operator’s obligation of active disclosure is strengthened,and the risks are strengthened.The second part analyzes the significance and theoretical basis of protecting online shopping consumers’ right to know.From the perspective of economic theory and constitutional theory,it is believed that the significance of protection lies in protecting consumers’ basic rights and maintaining normal market order.The third part analyzes the types of behaviors that violate the online shopping consumer’s right to know,and analyzes them with cases.summarizes from three aspects: relevant legislation,administrative supervision,and relief protection.After that,three reasons are concluded: imperfect related legislation,insufficient administrative supervision;relief mechanisms are difficult to guarantee.The fourth part focuses on introduction of the current status of protection outside the region,and it can be used for reference.First,expand the scope of protection of the right to know.Second,attach importance to the safety of transaction links.Third,improve dispute resolution mechanisms.The fifth part puts forward suggestions to improve the protection of online shopping consumers’ right to know.The author analyzes from four aspects: improving laws and regulations,perfecting relevant legislation,strengthening administrative supervision,and improving judicial relief mechanisms.At the same time,we mustbuild an online dispute resolution mechanism,give full play to the role of social supervision,and improve the awareness and ability of online shopping consumers to safeguard their rights. |
