Research On Legal System Of Online Shopping Food Safety Supervision

In recent years,with the continuous development and popularization of Internet technology,China’s online food industry has developed rapidly.However,the quality problems related to online food shopping are also exposed,causing social concern.Some online food operators seek illegal economic benefits and illegally sell substandard food on the Internet platform,which affects the healthy development of online food safety market.At present,China’s laws and regulations on online food safety supervision are still relatively lacking,and the illegal online food trading behavior can not be punished by law.On the basis of deep understanding of the current situation and existing legal problems of online food safety supervision,this paper discusses the theoretical basis and implementation path of improving the legal system of online food safety supervision from the aspects of legal basis,supervision subject,third-party platform,supervision procedure,relief system and supporting measures.In addition to the introduction and conclusion,this paper consists of the following four parts:The first part is the basic theory of the legal system of online food safety supervision.This part first introduces the meaning of online shopping food,the meaning and characteristics of online shopping food safety supervision;secondly,it expounds the elements,theoretical basis,objectives,principles and links of online shopping food safety supervision;finally,it combs the connotation,structure and value of online shopping food safety supervision legal system.The second part is the investigation of the legal system of online food safety supervision.This part elaborates from three aspects.First of all,it introduces the current situation of China’s online food safety supervision legislation from the legislative level;in fact,it introduces the current situation of China’s online food safety supervision law enforcement from the law enforcement level;finally,from the supervision laws and regulations are imperfect,the supervision subject configuration is unreasonable,the third-party platform supervision system is imperfect,the supervision procedure is not standardized,the supervision relief system is absent and the supervision coordination This paper discusses the legal problems in the supervision of online food safety from six aspects.The third part is the experience and Enlightenment of the legal system of online food safety supervision.This part expounds the characteristics and experience of online food safety supervision in the United States,the European Union and South Korea,and holds that China should draw lessons from and formulate relevant laws and regulations,set up reasonable supervision authorities and strengthen the experience of responsibility investigation of supervision subjects.The fourth part is the suggestion of the legal system of online food safety supervision.This part puts forward constructive suggestions from six aspects: legal basis,supervision subject,third-party platform,supervision procedure,relief system and supporting measures.Improving the legal basis mainly involves two aspects:broadening the scope of supervision and improving the level of legislation;the functions of the main body of supervision mainly involve setting up specialized supervision organs and establishing specialized technical departments;the third-party platform mainly includes improving the consumer evaluation system and establishing the after-sales coordination mechanism;the supervision procedure mainly includes improving the access mechanism,supervising the food information source and establishing the exit mechanism;and the rescue The economic system mainly expounds the relief to consumers from two aspects: the accountability mechanism of the regulatory body and the expansion of the scope of state compensation.Finally,the legal rights of consumers are protected by standardizing the online food safety credit system and improving the information disclosure system.
