Cruising taxi,or traditional taxi,is an important part of China's transport system,which provides convenience for people's daily travel.The development of cruising taxi in China can be traced back to the 1990 s.Its development has gone through three stages,namely,development,prosperity and stability.For each stage,the management of cruising taxi in China is also different From the beginning of encouragement to the present franchise system,there are background and reasons for its implementation.The concept of "franchising" was first proposed by western scholars.The international research on franchising covers civil franchising and administrative franchising.Unlike civil franchising,administrative franchising gives franchisees the right to engage in certain behaviors,and does not need to bear the liability for compensation after the termination of franchising.For franchising,the legal support in China is the five franchising items stipulated in Article 12 of the administrative license law,and the cruising taxi meets the provisions,so the franchising system in the administrative law should be applied to it.The franchising system,including the granting subject,is characterized by multiple government and object as well as special regulatory means.It is regulated by strict price control and quantity control.It has the functions of improving transaction efficiency,protecting the interests of passengers,controlling vehicle investment,improving traffic pressure,stabilizing market order,and ensuring driver's income.Therefore,it is necessary to continue to implement the franchise system in China's patrol taxi industry.But with the social changes and economic development,especially in the context of "Internet plus",the development of cruising taxis is facing more and more challenges.China's tour taxi franchise system is facing the challenge of online car hailing,which not only diverts the source of tour taxi customers,but also causes a certain waste of resources such as vehicles and venues.In addition,the high amount of "member money" of tour taxi also seriously affects the income of taxi drivers,making them unable to make ends meet,and the income between online car hailing and tour taxi drivers The serious imbalance of interests has caused a huge gap to the psychology of tour taxi drivers.At last,the taxi companies also face the problem of operating difficulties.In fact,the operation of cruising taxis has become a major concern of all countries.The United States,Britain and Japan have taken certain measures and methods to deal with them.These measures are nothing more than the reform of price control or quantity control.For the practical problems brought about by the franchise system,at present,there are two main views of Chinese scholars: one is that the franchise system should be abolished completely,which is the root cause of all hazards;the other is that there is no need to change the franchise system subversively,but to reform it in line with the development of the times.The arrival of big data era has brought severe challenges to both taxi drivers and companies,and has led to a series of negative consequences.The reason is that the franchise system can not fully adapt to the development of the era,some of which can not play a positive role in encouraging,but become a constraint to the development of taxi passenger transport market.In order to promote the healthy and steady development of the patrol taxi industry and protect the legitimate rights and interests of taxi companies,drivers and passengers,the reform of the franchise system of the patrol taxi is imminent.It is not only related to the healthy and orderly development of the whole industry,but also related to the convenient and safe travel of the public.The reform of the franchise system should include two aspects: first,from the general idea,we should return to the nature of the public transport service of the patrol taxi,adjust the interest relationship between the taxi driver,the company and the government,change the current situation that the driver is at the bottom of the interest chain,and regulate the income gap between the patrol taxi and the network taxi driver,In order to maintain the normal competitive order of the industry,we should also issue a proper amount of tour taxi franchise license to explore the deregulation of quantity and accumulate experience for the future reform and development;secondly,according to the overall thinking,we should put forward specific reform ideas,from the establishment of a unified vehicle allocation system for taxi companies,the establishment of a reasonable taxi "member money" system,and the establishment of tour taxi rental system Starting from the system of ensuring the minimum revenue of normal operation of vehicles,reforming the social security system of tour car taxi drivers,establishing the tax relief system of taxi companies and promote the coordinated development of cruising taxis and booking taxis,taking into account both entities and procedures,we will effectively promote the reform of the franchise system.
