The Practical Exploration Of Social Workers As Representatives Of Children's Rights

In recent years,influenced by the transition of economic system and the all-round transformation of society,marriage and family in China have shown a trend of diversification in ideology,culture and interests,and then a tremendous change has taken place.This change has led to a trend of multiple family conflicts in a short period of time,which eventually leads to the rising divorce rate.Most of these divorced families involve minor children.The problem.At the moment of the dissolution of marriage,both parents over-consider the interests of individuals and neglect the interests of minor children,resulting in their inability to actively express their personal demands and passive acceptance of the outcome of the case judgment,thus violating their rights and interests.Since 1970,the United States,Germany,Japan and Taiwan have introduced legal systems to safeguard children's rights and interests one after another,which shows that the protection of children's rights and interests is very important in the world at present.Therefore,the mainland of China also needs the emergence of litigants who can fully represent the rights and interests of minor children,and it is urgent to establish the system of child rights and interests representatives.In addition,the system of child rights representatives in China is still in the exploratory stage,and has not formed a perfect system.Therefore,it is necessary to explore the process of practice.Based on this,this paper hopes to make a systematic and comprehensive discussion on social workers acting as representatives of children's rights and interests in mainland China by drawing lessons from existing experience.In this paper,qualitative research method is used to explore social workers as representatives of children's rights and interests.Through in-depth interviews,we can understand the professional advantages,role connotation,rights and obligations of social workers as representatives of children's rights and interests,so as to embody the legitimacy of social workers as representatives of children's rights and interests,and comb out a set of systematic service processes according to the existing work forms,so as to achieve the purpose of replication and application.In order to ensure the smooth operation of the process,practical difficulties are found and solutions are proposed under the existing circumstances.The results show that the system of child rights Representatives has practical significance.It can protect the interests of minors in family affairs from infringementand maximize the interests of children through the establishment of the system.In addition,the role of social workers as representatives of children's rights and interests has many advantages.Social workers can use their profession to apply ethics such as listening,empathy,confidentiality to their work,help minors clarify the focus of contradictions and analyze the status quo,and also help the case owners integrate resources to achieve the purpose of solving problems.In view of the above findings,the author finally puts forward some suggestions to strengthen the penetration of the concept of child rights protection from the ideological level,arouse people's attention to the protection of children's rights and interests,ideologically based on the rights and interests of children themselves,and safeguard the maximization of children's interests.From the legislative point of view,we should strengthen legislation,promote the legislative process,establish special family affairs law or amend existing laws to ensure the legitimacy of child rights representatives.From the institutional level,we should improve the system and service process,improve the existing working mode by drawing on other advanced experience,and increase the monitoring mechanism according to the actual situation,so as to ensure the overall protection of children's rights and interests from the institutional level.
