China has taken great adjustment of the basic state policy on family planning to adapt to the changes in the size and structure of China’s total population and promote long-term, balanced population development. Now china has implemented One-Child Policy(hereinafter referred as the two-child policy), which demonstrates that either parent is an only child, then they are eligible to have two children of their own. The adjustment of the basic state policy on family planning must have enormously influenced on the exercise of women’s rights, while, unsolved problems of sexism under the one-child policy has been more prominent with this reform. The new policy has been carried out for one year. Yet the state policy on family planning in both national and local government law has still been improved. The application of Sociology of Law and Social Gender will have great impact on the achievement of Rights of Person, Economic and Employment Rights and Marriage Rights. It will also analyzes the reasons comprehensively and explore the root of this influence. In the end, it suggests solutions of the improvement at the legislative level and judicial level, refraining from the aggravation of sexism in terms of the policy itself or coordinated measures, to protect the exertion of Women’s Rights under the affect of this new policy.
