Food is a crucial necessity of human being,with its safety highly correlated with social stability.With this acknowledgement,China' s regulatory body is elevating its emphasis on food safety,progressing from a single authority management to one involving multiple participations,aiming to strengthen the responsibilities of producers and the rights of consumers.The newly revised Food Safety Law,that come into effect on 1st Oct.2015,pinned down on questions of cross-regulatory supervisions and red-tape bureaucracies that remained untapped by the Food Safety Law of 2009.Along with the promulgation of"Consumer Protection Law" in 2013 and the latest "Judicial Interpretation of the Supreme People' s Court for Food and Drug Administration",a new wave of public participation towards the issue of food safety has been triggered,furthering the positive impact of supervision on food safety.It is evident that participations of consumers,being the main stakeholders involved,played a vital role in the implementation of food safety laws.However,the existence of certain loophole in such mechanical supervision does put the supervision body and producers into conflicts.The so-called "professional anti-counterfeiting agents",with their punitive motives in mind,filed complaints and discontents towards producers under strict terms of Food Safety Laws,aiming to extract profitable earnings as producers are often reluctant to go through the complexities of court investigation.This transition of anti-counterfeiting agent into“claimant" have increasingly pose direct clashes between tiers of food safety governing authorities and food producers nationwide.In order to solve this chaotic social conflict of interests,this article offers three resolutions through the lens of a micro-enterprise entity.Firstly,this article argues for further government-initiated supervisions,alongside the explanation of judiciary terms,including regular food inspection and quarantine,and the cultivation of third-party testing agency.Secondly,the enforcement of laws towards malicious illegal producers should run parallel with those towards“professional anti-counterfeiting agents”,simultaneously promoting certain aspects of self-protection awareness and accountability.Furthermore,this article claims for the reformation of a more convenient and multi-channel system of judicial proceedings as an efficient tool to congruent the mutual interests of different stakeholders involved.These are vital measures to achieve and uphold and effective system of food safety law.
