Viewing China'S Tobacco Monopoly System Reform From The Perspective Of Prohibition System

The whole process or part of the production,transportation,and sales of a country's monopoly of a specific product is called monopoly.The current tobacco monopoly system in China can be traced back to the prohibition system in ancient times,and its purpose and function are similar to the prohibition system.It can be said that the prohibition system is the source of national monopoly,and on the other hand,tobacco monopoly can be the development of the system in modern times.Therefore,this paper studies the tobacco monopoly system from the original monopoly system,"ban",explaining the origin,formation conditions and evaluation of the ban system,and gradually transitioning to the current tobacco monopoly.There are critical views on the evaluation of the prohibition system in the academic circle of law,history and economics.However,in my opinion,we should not make a general judgment on the quality of the system,but evaluate its role in the whole history with dialectical thinking.The law has a history of more than 2,000 years in China.It plays an important role in safeguarding national security and obtaining financial revenue,but it also hindering the formation and development of capitalism,and eventually it will gradually die out with the abolition of the feudal system.At present,China's tobacco industry is at a critical moment of historic transition.In the modern society,with the improvement of health consciousness,people increasingly recognize that tobacco harm to people's health,besides,the problems of itself increasingly exposed,and since China's accession to the WTO,to face competition from the international tobacco industry especially big tobacco,and the rise of the worldwide campaign against tobacco,all bring huge impact to the tobacco industry of our country.The domestic situation is also grim.Local monopoly has replaced the monopoly on tobacco which should be led by the state.There are distinct barriers between tobacco markets and serious market segmentation.Moreover,the deep-seated institutional contradictions in the tobacco industry are increasingly exposed,and the internal management of the tobacco industry is also nested and the division of rights is chaotic.These problems not only provide opportunities for the popularity of illegal cigarettes,but also significantly increase the difficulty of tobacco administrative law enforcement.However,due to the great contribution of tobacco monopoly system to China's finance and taxation,it cannot be replaced in a short time.In addition,due to the imperfect legal system and the relative complexity of social environment,the time for abolishing tobacco monopoly system is not yet ripe.However,faced with the existing difficulties,the reform of tobacco monopoly system is imperative.There have a lot of discussion about the tobacco industry to save waste debate,however,are mostly put forward by introducing competition to improve the efficiency of the tobacco industry to increase production,enables our country current tobacco monopoly system transition to privatization and marketization mode,but because of tobacco is addictive and damage to the particularity of public health,so the competition is not feasible.The reform of China's tobacco monopoly system should be transformed from administrative monopoly to economic monopoly,weaken the color of tobacco industry's administrative monopoly,and strengthen its monopoly position to ensure the realization of tobacco control goal and fiscal revenue.
