Problem Of The Rural Housing Land In XinNing Country

At present,China is experiencing the process of elimination of urban urban-rural dual structure,urban and rural land system reform is imminent,and the problemofrural residenceland is very serious.The main problems are manifested in the conflict of the power in the use of residential land,andthe border ofthehomestead rights isconfusion,such as right ofusing homestead and ownership.The use of rural residential landin China has been concerned about and questionedby the masses and the media,and affecting the development of China's rural areas and social stability.Based on the relevant theory of property rights,this paper makes a detailed investigation on the present situation of rural homestead system in China,and tries to put forward some suggestions on the reform of rural homestead system in combination with the rapid urbanization in our country.This paper,firstly,carding the development process of the rural homestead,and then thoroughly investigates the situation of the use of rural homestead,the farmers ' cognition of homestead system and rights,and analyzes the successful cases of the rural homestead system reform in the relevant region,and traces the development course of rural homestead in China and the main problems existing in the homestead system.It can be summed up as follows: the prevalence of multi-family within one unit built,the high vacancy rate of homestead,the narrow coverage of homestead registration,the delay of property right alteration,and the unreasonable system of homestead exit compensation.In the process of the investigation of the farmers ' cognition of the system and rights of the residential base,it can be found that the farmers ' understanding of the homestead system is not enough,the private property right concept of the homestead is strong,and there is a strong willingness of homestead transition,which is not satisfied with the existing compensation system.Finally,through the successful case decomposition of the rural homestead system reform in the relevant region,this paper sums up the pilot regional experience of the rural homestead system reform in China,and carding the advantages and disadvantages of various homestead systems.The paper also puts forward some suggestions on the further development of the residential land use system in China: establishing and perfecting the protection system of the rural homestead's rights and interests,combining the use of economy and law to control the illegal expansion of homestead,perfecting the circulation market of rural homestead,making a reasonable compensation system based on market transaction.
