Tne Regulation Study Of Electric Business Platform Based On The Public Trust Of Consumers

The advent of the era of "Internet +",has given priority to the new commodity trading mode relying mainly on electric business platform,which facilitates people's work and life greatly.However,behind the huge trading volume and large numbers of net shopping consumers,more and more merchants from electric business platform are selling fake goods,which has been banned in China but widely practised,network consumers are losing their credit to retail electric business platform.According to the principle of rights and obligations are consistent,to some extent,more money means more responsibility.Electric business platform make profit by its technical service?advertising services and intermediary service,so it shall take corresponding responsibility for its merchants selling fake goods.There is a controversy at home and abroad about how to define the legal responsibility of electric business platform accurately,and also the verdict is different in the legal practice.The tough attitude from European countries and the easing attitude of the United States have reference significance to our country.At present,thedefinition of responsibility for electric business platform mainly has two kinds,one is the conditional vicarious liability,the other one is the conditional joint and several liability.Electric business platform has no responsibility for online consumers except in the specific conditions,which is not consistent with its rights,the responsibility of electric business platform is weakening.This article attempts to analysis the case from European countries and the United States,combining with the actual situation of our electric business platform,encourage electric business platform to regulate itself by improve the introduction system,evaluation system,compensation system and return system.
