Agriculture is the basic industry for the survival and development of human society,and it is a major issue concerning the economic development and social stability of the country.Insufficient production funds are important factors affecting the development of agriculture in various countries.At present,some countries such as the United States,Germany,and Japan have adopted agricultural land mortgage loans to alleviate the problem of tight agricultural funds in their countries.Since the beginning of the 21 st century,all parts of the country have begun to explore mortgage loans for agricultural land management rights.In 2015,the State Council promulgated the “Guiding Opinions on Piloting the Management Rights of Rural Contracted Land and Farmers' Housing Property Mortgage Loan”,and required the pilot work of contracting land management rights and peasant housing property rights mortgage guarantee loans.Pingxiang County of Hebei Province has been identified as one of the pilot areas for mortgage loans for agricultural land management rights,based on the results of previous land confirmation and land transfer platform construction.After several years of exploration and development,the Pingxiang County farmland management rights mortgage loan has achieved good results,but at the same time there are some problems and deficiencies.Based on the analysis of the development status of agricultural land mortgage loans in Pingxiang County,this paper points out the problems and analyzes the causes,and then puts forward corresponding countermeasures and suggestions to promote the better development of rural land management rights mortgage loans in Pingxiang County.This paper mainly uses literature research,field research,comparative analysis and other methods.Through combing the research results of farmland mortgage loans at home and abroad,the main theories,viewpoints and methods are summarized,which provides reference for the research of this paper.According to the institutional constraints and related policies of China's agricultural land mortgage loans,based on the theory of land property rights,land rents,mortgage guarantees,etc.,through in-depth discussions and investigations on financial institutions,creditors,property rights trading centers and other related subjects,in-depth understanding of Pingxiang County The farmland mortgage situation,and select Yutian County and Qiu County to compare with the basic conditions of the mortgage loan,the acceptance rate and the issuance rate,the loan interest rate and risk,the risk monitoring means,the risk transfer and the apportionment mechanism,etc.Point out its problems.This paper focuses on the analysis of five aspects.The first is to sort out the development history of the farmland management rights mortgage loan in Pingxiang County,and divide its history into three stages according to the development characteristics: basic conditions construction,mortgage loan pilot and legal guarantee.The second is to analyze the development status of farmland mortgage loans in Pingxiang County from the perspectives of participating entities,mortgage objects,mortgage scale and mortgage structure.It is found that the financial institutions involved in farmland mortgage are mainly local banks,and the creditors are new-type businesses.The main body is the main body;the mortgage object is “farmland management right + ground attachments”;the scale of farmland management rights in Pingxiang County has increased year by year,and good results have been achieved;the mortgage period is mainly 3-9 months,and the mortgage amount is 100,000-300,000 yuan,which is consistent with the cyclical and small capital characteristics of agricultural production activities on family farms.The third is to analyze the problems of agricultural land mortgage loans in Pingxiang County,including weak mortgage loan base,low mortgage loan acceptance rate and disbursement rate,low loan interest rate risk,lack of risk monitoring means,and urgent need for risk transfer and allocation mechanism.The fourth is to analyze the causes of the problem from the market operation mechanism,credit information system,willingness of participants,guarantee insurance,etc.,mainly including insufficient staffing of the two-level platform of land transfer township(township)and village,lack of professional training for farmland transfer brokers.The rural credit system has not yet been established,and there is a lack of credit records for farmers and new business entities.The review of unfamiliar creditors is too strict;the agricultural land mortgage loan has low profit risk,and financial institutions lack participation enthusiasm;The development of agricultural insurance is still not perfect.The fifth is to propose relevant countermeasures for problems and causes,mainly including expanding the scope of cooperation of financial institutions,clarifying loan standards,establishing and improving land transfer platforms,improving land transfer rate,improving insurance cooperation,ensuring operating income of creditors,and establishing risk monitoring systems.To prevent overall risks.The innovations of this paper are: First,the deepening of the research perspective.At present,the research on farmland mortgage loans focuses on analyzing the necessity,influencing factors and countermeasures at the macro level.Based on the previous achievements,this study selects the trial of agricultural land management rights mortgage loan under the existing policy framework.Pingxiang County,which has experience and legal practice,is a typical case.Based on the microscopic level,the method of “anatomy sparrow” is adopted to systematically analyze the rural land management rights mortgage loan in Pingxiang County in order to obtain universality.General understanding.The second is to change the previous method of “talking about the status quo and problems”.This study uses systematic analysis and comparative analysis to put the results into the three stages of construction,pilot and comprehensive development of agricultural land mortgage loans.Through the comparison with the relevant counties and cities such as Yutian County and Qiu County,the problems existing in Pingxiang were analyzed.
