| As the basic rural management system in China,the family management system has been operating smoothly for more than 40 years,which is not only maintains the overall stability of the rural social environment,but also provides a guarantee for increasing agricultural production,farmers' income and food safety.However,in the course of historical changes,it occurs some problems such as the actual land area of farmers' contracted land that is not in accordance with the contract area,unclear four-sidedness,unclear spatial location,incomplete registration books and so on.It is necessary to make clear and define the ownership right,contract right and management right of the land under the premise of stabilizing the current contract relationship,so as to protect the farmer'legitimate rights and interests in the contracted land.The confirmation of the right of agricultural land is conducive to stabilizing and consolidating the contractual relationship of agricultural land,clarifying and guaranteeing the ownership of land contract management,establishing and perfecting the information management of land contract,ensuring and deepening the reform of agricultural countryside,planning and promoting the moderate scale management of agriculture.It is not only a strong guarantee for promoting the transformation of agricultural production mode,but also a strong demand for stabilizing the development of rural society.Through the literature study,combined with theoretical basis,the research object of this paper is to confirm the right of agricultural land in Shuangyang District.On the basis of detailed investigation and analysis of the basic situation,the procedure of confirming the right of agricultural land,the results achieved at the present stage and the existing problems of Shuangyang District,this paper expounds the disputes over the ownership of land in some areas during the process of confirming the right of agricultural land,the insufficient support for confirming the right,the discrepancy between the measured area and the contract area,the loss of original data and the change of household registration information,the disputes over land in Shuangyang District.Analysis of the deep causes of the above problems through classified and sorted the problems,summarized the causes from the angles of law,system,history,man-made,technology and natural conditions,in the meantime,combined with the experience of advanced areas with good experience of the completion of the right to confirm agricultural land in China,and then the conclusions are analyzed.The main reasons for the problems in the process of confirming the right of agricultural land and some areas not to complete the right of confirming agricultural land of Shuangyang District are imperfect legal policies,omissions in institutional changes,problems left over from history,human factors,inadequate technology and natural conditions.According to the conclusion of the analysis,then put forward some targeted recommendations like democratic consultation based on laws and regulations;improve the arbitration system and encourage grassroots resolution;establishing information platform and forming long-term mechanism;do the data confidentiality better and make clear the responsibility of the main body;improve the circulation platform and standardize the flow procedures;promote the transformation of results and release the dividends of confirmation rights and so on.It provides the solution for finishing the work of confirming the right of agricultural land,promoting the transformation of the result of confirming the right,and further releasing the dividend of confirming the right to Shuangyang District. |
