Research On The Development Of Copyright Insurance In China

Innovation is the first driving force to promote China's economic development.The implementation of innovation driven development strategy is the basic national policy of the party and the state.In the process of building an innovative country,the protection level of copyright has become an important standard to measure the degree of innovation of a country.The copyright industry has always been one of the core industries in China.In 2018,the added value of the copyright industry reached 6.63 trillion yuan,accounting for 7.37% of the GDP.It can be seen that the copyright industry has made great contributions to the national economy.However,as more and more people understand that copyright contains great economic value,the risk of infringement is gradually increasing.When people face the copyright infringement disputes,they usually choose the judicial way to solve the problem,but the high amount of damages and litigation costs make the cost of safeguarding rights higher,which is hard for some rights holders to bear.The copyright subject needs a new way to protect their rights.Copyright insurance is another effective way to protect copyright by transferring the risk of copyright owner to the insurer by paying a small amount of premium.At present,it is the key period to build an innovative country.China should develop copyright insurance to provide impetus for building an innovative country.The structure of this paper is as follows: the first part introduces the case that Ping An Property Insurance launched copyright protection insurance;the second part analyzes the significance of cases to copyright protection system,insurance industry and copyright owners;the third part demonstrates the necessity of developing copyright insurance in China from the aspects of risk management,industrial effect and legal system,and the feasibility of tort cases,registration quantity,insurable risks and policy support;the fourth part combs the development process of copyright insurance in China,and puts forward the existing problems for the four main bodies participating in the copyright insurance,namely the holder,the third-party platform,the insurance company and the government;the fifth part introduces the developmenthistory of intellectual property insurance in the United States,the United Kingdom,the European Union and Japan;in the sixth part,aiming at the problems in the fourth part and combining with the basic national conditions of our country,six suggestions are put forward,namely,to expand the effective supply of copyright financial products,to establish a unified public service platform for copyright,to use blockchain technology to evaluate the value of copyright,to increase the research and development of copyright insurance products,to improve the relevant legal systems of copyright insurance and to play the leading role of national policies.
