Legal Research On Technical Standards Of Meili Highway

The juristical research of the technical standard of Meili highway belongs to the research field of transportation industry law.On April 1,2020,the Ministry of Transport released the list of existing and compiling highway engineering industry standards,including the "Beautiful Highway Technical Specifications",which clearly stipulates the first principles to be followed in the formulation of the beautiful highway technical standards.The formulation of the technical standard of Meili highway is aimed at promoting the realization of the strategic goal of traffic power and the modernization of China’s governance system and governance capacity.This paper aims to explore the formulation and implementation of the technical standard system of The Beautiful highway from the theoretical perspective.This paper combines the relevant disciplines of engineering law theory and law aesthetics theory,and comprehensively applies the methods of analysis induction and interdisciplinary intersection to carry out the research.In theory,combining with the law of engineering law,the legal principles contained in the relevant provisions of Highway Engineering Technical Standards are explored.In practice,combined with the series of rules and regulations of the beautiful highway construction,we find the application law of its technical standards and other related legal principles.This paper analyzes its problems with legal thinking,and puts forward feasible Suggestions for the formulation and implementation of the technical standards of The beautiful highway with the help of legal expertise,so as to promote the orderly development of the beautiful highway construction.The text research content is divided into four parts: The first part,the definition of the concept of the beautiful highway technical standard,which provides the theoretical basis for the following;The second part,according to our country "highway engineering technical standards" [build the highway commission,highway engineering technical standard(JTG B01-2014),[M].People’s traffic press,December 2014.] related content,from the aspects of principle,system and technical specifications of three beautiful road technology standard is put forward in the process of the formulation and implementation of possible problems;The third part analyzes and discusses the problems encountered above from the three aspectsmentioned above.The fourth part,put forward some feasible jurisprudence thinking,in order to achieve for our country beautiful highway construction to provide a complete legal theory system.To explore and improve the technical standards of the beautiful highway conforms to the legal requirements and trend of the rule of law.It is also the legal value of guaranteeing the order and fairness of highway social relations and realizing people’s good travel wishes in highway traffic social relations.In the new era,discovering the beautiful roads in perfect technical standard theory,the legal thinking continuously,into the green innovation system and supervision system,to protect Shared,green,safe and efficient road order,enhance the level of the quality of the people good,realize the goal of construction of beautiful China,a positive role in promoting.
