Research On Contractor’s Claim Of JN Garden Project Under COVID-19

Since the discovery of unknown pneumonia in Wuhan in December 8,2019,the Wei Jian Committee of the National Committee of the CPC has put New Coronavirus pneumonia into the class B infectious diseases stipulated by the infectious disease prevention act in January 20,2020 and adopted the prevention and control measures of class A infectious diseases.The development of New Coronavirus pneumonia outbreaks people’s imagination.In order to prevent and control the spread of New Coronavirus pneumonia,most local governments in the country have launched a "major public health emergency response" and issued a notice on delaying the resumption of enterprises and taking special measures.The construction industry is a traditional labor intensive industry,and has a high correlation with the upstream and downstream industries.The impact and impact of the construction industry on COVID-19 are multidimensional.Only the policy of delaying the resumption of work in the early stage of the epidemic has a significant impact on the construction period,the use of machinery and equipment,and the construction cost.Based on this,the housing and construction departments of 23 provinces and cities have confirmed the implementation methods of project cost adjustment during the epidemic prevention and control period.The Supreme People’s court also issued trial opinions on how to adjust the project price and balance the losses of both parties in the construction project disputes during the epidemic period.In the new stage of social development,in the face of special policy requirements and judicial norms during the period of COVID-19,the Contractor’s claim in the face of sudden outbreaks should also keep pace with the times.Especially in special cases,how to make good use of legal weapons and correctly put forward and realize the claim is of great significance for the contractor to safeguard his own legitimate rights and interests,reduce contingent disputes and improve economic benefits.This paper mainly studies the whole process of contractor’s claim for COVID-19 JN garden project.The first chapter of the paper describes the research background,reviews the literature at home and abroad,summarizes the shortcomings of the relevant research results at home and abroad,puts forward the research topic,introduces the research purpose and significance,research content,innovation,research methods and technical route of the paper.The second chapter discusses the related theoretical issues of the construction contractor’s claim,which provides a theoretical basis for the contents of the third and fourth chapters.The third chapter introduces the JN garden project,and puts forward the basis and claim strategy of the Contractor under COVID-19.The fourth chapter puts forward the implementation plan of the claim strategy proposed in the third chapter and evaluates the claim effect.Based on the former two chapters,the fifth chapter puts forward some suggestions on the Contractor’s claim in the case of outbreak.The sixth chapter summarizes the research of this paper,and puts forward the problems to be further studied.
