A Report On Chniese Translation Of International Business Law:Cases And Materials From Functional Equivalence Theory

As global economic integration accelerates its pace and China implements the initiative of Belt and Road,China and Western countries are having more and more economic exchanges,making international business transactions increasingly important.International Business Law,as the combination of the laws regulating behaviors of different business organizations plays an irreplaceable role during their trade activities.In order to well understand the business laws of western countries to catch up with the globalization of business law,China’s enterprises should try best to read and study related legal documents and literature.There are great differences between Chinese and western laws: China adopts the Continental Law System,following the statute law,while in UK and USA,the common law system prevails with case law as their focus.Therefore,how to effectively link their law system with Chinese law is an important task for translators and legal researchers.Legal translation has long been an important means in the process of realizing effective communication between the Chinese and American law systems.When translating legal documents,a translator will put top priority on how to translate the source text into target language correctly,realizing equivalent linguistic and legal functions.The International Business Law: Cases and Materials is an excellent publication on business law but currently,there is no official translation published in China.This book quotes a large number of cases of the Anglo-American Law System and can be used for reference in China.Therefore,under Eugene Nida’s Functional Equivalence Theory,the author translates and analyzes some chapters of the paper.This translation practice report bases on extensive analysis on cases and combines theory with practice with the aim of practicing Nida’s theory in translation of authentic legal documents.This translation practice report falls into four parts: translation task description,translation process,case study and conclusion.The first part introduces the development needs of International Business Law translation and the basic contents of the three selected chapters.The second part describes the process of pre-translation preparation,translation and edit after translation.The third part analyzes the methods of translating legal texts from the aspects of words and sentences by enumerating examples in the translation task.This part under the Functional Equivalence Theory focuses on the translation of professional terms,translation of legal words composed of common nouns,the conversion of active and passive voices,and translation of long sentences.The last is the conclusion part,which systematically summarizes the entire process of the legal translation under the Functional Equivalence Theory.
