| With the development of international human rights cause and the enhancement of citizens’ awareness of human rights,as well as the development of China’s disaster relief management system in recent years,more and more people have begun to pay attention to the protection of human rights of victims.The human rights of victims include not only the right to life and survival,but also the right to live on,and the protection of these rights is the unshirkable responsibility of the state and society.As a legal saying goes,"rights are not rights if there is no relief".As a special form of human rights,the rights of victims should be timely relief when disasters happen.Japan has a more complete relief system and more detailed legal provisions on the protection of the rights of victims.In addition,the protection of the human rights of disaster victims is not only limited to disaster emergency relief and post-disaster reconstruction,but also focuses on the cultivation of residents’ crisis awareness and post-disaster psychological recovery in the pre-disaster prevention.However,China’s disaster management construction started late,and many regulations did not start from the reality of the protection of the rights of victims,which has great deficiencies.Therefore,we can learn from the successful experience of disaster management in Japan,and provide a standard for the protection of human rights of victims through the improvement of the legal system of disaster management at the national level.Then,we can build a concrete system construction from the perspective of protection of rights of victims. |
