Research On The Role Of Public Security Police In Handling Abnormal Petitions

Petition is a unique right relief system in China.It is a form of guarantee for citizens’right to criticize,advice,accuse,and appeal.At the present stage,with the continuous development of our society,the phenomenon of uneven distribution of interests and various social contradictions are becoming increasingly prominent.When their rights are infringed,people usually take the way of letters and visits to relieve their rights.However,because there are still some defects in our country’s letter and visit system at present,some people will take non legal means to reflect their demands when their own demands are unable to be solved or dissatisfied with their reply.So the abnormal petitions have come into being and get more and more.In recent years,a new trend has been presented.The main manifestation is that the scale is increasing,the face is more and more extensive,and the behavior is more and more extreme,so5e behaviors even impact on the normal social order,so the local government departments work as an important maintenance task.Public security police,as the main force to deal with abnormal petitions,the correct position of the role of the police is related to whether the conflict can be resolved quickly and properly.At present,the role of the police in handling abnormal petitions has the role of fighting crime and maintaining social order.There is a role given by the government to obey orders and obey commands;the role of social expectations to protect the public’s interests and the role of the public security police’s self-perception In theory,these roles are all in line with the requirements of the police’s functions.However,due to the conplexity of the actual work,these roles have interwoven in the handling of abnormal petitbns,resulting in some public security police working in the process.There are problems in role orientation,then conflicts between social control and civil rights protection,dislocation between the disposal subject and the auxiliary,contradictions between rigid law enforcement and flexible law enforcement.The main reason for this problem lies in the imperfection of o ur legal system,the de finition of the abnormal petition and the treatment of the abnormal petition are not clearly stipulated,so that the public security police cannot be able to rule;The public security police have some mistakes in the cognition of the current situation,some leaders ’decision-making mistakes,and serious "official standard" ideology.The task of public security work is complicated,resulting in work fatigue;and unusual petitions have a certain complexity.This article takes the whole process of Beijing Public Security Police’s handling of an abnormal petition by a certain SK group as an example,combs the disposal of Beijing Public Security Police according to the order of the time line,and analyzes the role played by Beijing Public Security Police at different disposal stages.It is clear that the public security police should perfect and strengthen four roles when dealing with abnormal petitions,the role of the public security police in maintaining social order,the role of the public security police in strictly enforcing the law,the role of the public security police in resolving contradictions,and the role of the public security police in intelligence gathering and evaluation.At the end of this paper,the author believes that the legal provisions should be made to perfect the legal provisions on the definition and disposal of abnormal petitions;at the institutional level,we should improve the working mechanism of the public security police to dispose of the abnormal petitions;strengthen the ability of the police to recognize and debug their roles at the level of their own understanding,through these three aspects.The corresponding debugging ensures that the public security police handle the abnormal petition role to achieve accurate positioning.
