A Study On The Legal Problems And Countermeasures Of The Pilot Reform Of Rural Collectively Managed Construction Land Use Right

The circulation of the right to use rural collective management construction land is a comprehensive product of the accumulation of state policy support,economic support and practice.At present,the problem that our country needs to solve urgently has changed from whether to allow the collective management construction land use right circulation to how to build the complete use right circulation supporting mechanism.Speeding up the link between the legal provisions and the policy system,strictly planning the boundary of land use for circulation and perfecting the income distribution system have become the key tasks to promote the reform of the circulation of the right to use construction land for collective management.In addition to the introduction and conclusion,this paper consists of four parts.The first part is the background and policy of collective management land use right circulation.This paper mainly defines the meaning and characteristics of the circulation of the right to use,and briefly explains the background and policy of the circulation.The second part is a practical exploration of the circulation of the right to use construction land for collective management.The author focuses on the practice exploration in the four aspects of circulation transaction subject,circulation scope,circulation purpose and circulation distribution system in typical pilot areas of our country,and carries on the overall evaluation and analysis to it.The third part is the legal issue of the circulation of the right to use construction land for collective management.It includes unknown attribution of rights,the generalization of circulation subject,the narrow scope of circulation transaction,the fuzzy boundary of land planning and use,and the imperfect income distribution system.The fourth part is the countermeasure research of collective management construction land use right circulation.It includes five aspects of targeted solutions,which are making it clear that the right is a usufruct,regulating circulation subject,expanding the scope of circulation transactions,strictly planning land use,improving the income distribution system.
