agricultural overall goals and requirements of the modernization of rural areas",this is in the new era of socialism with Chinese characteristics under the background of new rural problems,in order to effectively solve the problem of rural social grassroots governance,rural grass-roots governance must be incorporated into the orbit of the rule of law.18 the fourth plenary session of the party put forward to promote the rule of law in an all-round way,build the modern country under the rule of law,and the important index to measure a country’s level of modernization is one of the stand or fall of governance,rural grass-roots governance is the basic link of national governance,is also an important part of national governance,thus to realize the modernization of national governance,must realize the modernization of the rural governance capability,this not only is the total requirement of rural revitalization strategy,the strategic layout of modernization of the national governance.Since the reform and opening up,"rural politics and village governance" has been the basic mode of rural social governance in China.The agricultural and rural policies of the party and the state in different periods have been implemented and implemented through the operation of "rural politics and village governance".Before the 18 th national congress of the CPC,the state carried out various legal governance activities in rural society through the operation of the institution of "township politics and village governance".In the new era of the modernization of national governance and the comprehensive promotion of the rule of law,the mode of "township governance and village governance" has encountered new difficulties.The 19 th CPC national congress and the strategy of rural revitalization have constructed a new framework for rural social governance to adapt to the development of rural society in the new era.In the system system of modern governance and rule of law theory,the governance of rural society under the rule of law is an organic co-governance in which diversified subjects exercise governance activities in accordance with the rule of law according to diversified rules and give full play to their respective due functions.Therefore,under thebackground of rural revitalization,it is the focus of this paper to discuss the difficulties faced by law-based rural governance in henan province,and to put forward effective solutions to these difficulties.Based on the deployment and realistic requirements of rural revitalization strategy,this paper studies the sustainable development of rural grass-roots governance.Specifically,this paper starts with the analysis of the basic concept and theoretical basis of China’s rural grass-roots governance and the interactive logic relationship between rural revitalization and rural grass-roots governance under the background of rural revitalization strategy.This paper analyzes the current situation of rural grass-roots governance in China from various aspects,including the reality of diversified governance subjects,diversified governance methods,in-depth governance fields and levels.And dilemma in the process of governance,which mainly include: one is the plight of national law and folk law conflict（national unity,modernity is in conflict with the local,traditional and folk law）,the second is unclear responsibilities of the governance body trouble（basic level between the government and the village committee,village party branch and the village committee,unclear responsibilities between the village two committees and other subjects）,three is a governance process behavior anomie phenomenon serious governance dilemma（frequent power rent-seeking behavior,the wind of formalism and selective governance phenomenon more）,four is the viewpoint of farmers’ subjective consciousness is not strong,the rule of law is weak;And on this basis combined with the beneficial experience of foreign countries put forward the corresponding countermeasures,Mainly has: first,consummates the management standard system,to promote governance norms under the rule of law,perfect the rural governance legal system,timely revision of rural folk norms,realize the benign interaction of national law and folk law),the second is to clear the governance body accrual（the transformation government function,promoting rules of governance,improve the leadership of the party,further demonstration governance,efforts to increase the ability of the broad masses of farmers to participate in grassroots governance,insist on autonomy,and the combination of virtue and rule of law governance means）,three is to optimize the rule of law culture supply（to innovate propaganda way,to update the rule of law propaganda,the rule of law to build the rule of law culture facilities）.
