| With the continuous development of e-commerce and technology,different types of e-commerce platforms emerge one after another.In order to better regulate the transaction behavior within the platform,each major e-commerce platform has established its own credit system within the scope allowed by law.Among them,the credit evaluation within the platform is an important factor that influences consumers’ decision on whether to buy the goods or services of the store,and it is also the core market competition factor of the e-commerce platform.Due to technology neutrality and market competition,e-commerce platforms operate independently,and credit evaluation information between different e-commerce platforms is not interoperable.In order to quickly improve their credit rating and gain market competitive advantage,some operators adopt such improper behaviors as single speculation or malicious evaluation and slander of competitors,resulting in serious credit evaluation distortion.This not only damaged the relevant rights and interests of consumers,seriously damaged the competitive order of e-commerce,but also ran counter to the social credit construction advocated by China.Therefore,based on the electric business platform of credit evaluation in our country as the research object,based on the research of scholars,using the method of literature research,data comparison,statistical charts,etc,to our country electric business platform of the credit evaluation of legislation present situation,the present situation,the regulation and regulation effectiveness in discourse analysis,reflect on our country electric business platform credit evaluation on the legislation and relevant supporting system and regulatory problems: one is the lack of legislation,including credit legislation lags behind,the law is too principle,legal norms about electric business platform credit evaluation legislative level is low and exists XiaWeiFa and host law provisions inconsistent situations;Second,in the existing supervision,there are some phenomena such as insufficient self-regulation of e-commerce platforms,relative lack of supervision of government departments,and not giving full play to the effectiveness of social supervision.Third,the relevant system construction of e-commerce platform credit evaluation is not perfect,mainly reflected in the credit rating setting is too simple and general;The credit evaluation index lacks the credit foundation and the independence among the major e-commerce platforms,the unimpeded mechanism of credit information and the imperfect legal liability system have not been formed.Based on the above problems,this paper puts forward specific Suggestions from the perspectives of constructing the principles and objectives of credit evaluation of e-commerce platform,improving the quality of existing legislation,optimizing multi-party joint supervision and improving the supporting measures of relevant laws.Raise the level of legislation,resolve the conflict between legal norms;Optimize the supervision function of government departments,strengthen the management responsibility of e-commerce platform,and give play to the social supervision effect;Improve the content setting of credit rating and introduce the consideration of credit foundation into the design of evaluation index;The disclosure and sharing of credit information can be realized smoothly,so as to make a small contribution to improving the credit evaluation of China’s e-commerce platform and promoting the construction of e-commerce field and social credit system. |
