Research On The Perfection Of Village Rules And Regulations

The report of the Nineteenth National Congress of the Communist Party of China proposes to improve the rural governance system of combining autonomy,rule of law and rule by virtue.Perfecting the rural governance system of combination of "three governance" is not only related to the strategy of national rural revitalization,but also closely related to the modernization of national governance."Autonomy","rule of law" and "rule by virtue" show the goal of rural governance from different levels.Autonomy emphasizes the democracy of rural governance,the rule of law attaches importance to the order of rural governance,and the rule of virtue pursues the harmony of rural governance.The village rules and regulations are the important carrier of the combination of "three governs".They are not only the autonomous norms created by all the villagers through the principles of democratic agreement,but also the governance rules of the state in the rural grass-roots society,or a concentrated expression of the traditional custom of rural ethtics.To a certain extent,the operation of village rules and regulations can reflect the governance effect of autonomy,rule of law and moral rule in rural society,so village rules and regulations undoubtedly play an important role in rural governance.Based on this,the article tries to examine the shortcomings of village regulations in rural governance from the perspective of the rural governance system,and gives some suggestions,namely,to strengthen the public opinion base of village rules by deepening the practice of village autonomy and exploring the effective realization of autonomy system,to ensure the legitimacy of village rules by strengthening the state law and improving the legal supervision mechanism of village rules and regulations;The incentive and restraint mechanism of moral norms strengthens the binding force of moral norms through the form of heteronomy,and strengthens the villagers’ identity to the village rules with moral norms as the main content.Taking the rural governance system in the new period as the theoretical vision to perfect the village rules and regulations will certainly give full play to the positive role of the village rules and regulations in the rural governance,and will also help to build a vibrant,harmonious and orderly rural society.
