| Since socialism with Chinese characteristics entered a new era,with the overall improvement of the modernization of the country’s governance system and governance capacity and the in-depth promotion of the rural revitalization strategy,the modernization of rural governance has received much attention.The 19 th CPC National Congress clearly proposed to improve the rural governance system that combines autonomy,rule of law and rule of virtue.In the process of promoting the modernization of rural governance,how to give play to the governance function of village rules and regulations has been attached importance to by the Party and the government since the new era,and has been mentioned in many important meetings and documents.In the process of China’s modernization,local rules in the process of rural revitalization has what governance value,play what kind of management function,what management limited,how to make use of village rules and better service in the rural governance,improve the ability in village autonomy,moral and law system,the study of these problems will help to develop quality ingredients of traditional agricultural civilization,It is of great significance to promote the improvement of rural governance system and the improvement of rural governance capacity.This paper takes Q Village in F Province as the research object and the resources of autonomy,rule by virtue and rule by law of the village rules and regulations as the research content.The value of village rules and regulations in the governance of the village is analyzed mainly through text analysis,participatory observation,in-depth interview and other qualitative research methods.It is found that the village rules and regulations are mainly presented in daily life in the form of organization,custom and law in the process of playing the role of rural governance,and play the role of organizational guarantee,moral support and legal support for autonomy,moral rule and rule of law respectively.Basis of the "organic law" in terms of autonomy,the village in addition to the election of village the basic-level organization,also by "domestic law" and "clan law" elected "council" and "room long time",mainly in the form of organization form to expand the main body of the village autonomy,to deepen the content of village autonomy,improve the autonomous self management,self supervision efficiency.In the aspect of moral governance,the village enriched the content of rural moral governance,expanded the methods of rural moral governance,and improved the efficiency of rural moral governance through the ceremony of praying for blessings,the ceremony of ancestor worship and the continuation of the good family tradition.In the aspect of rule of law,as the existing form of customary law and as the expression form of national law,township rules and conventions are integrated into the text statute,which mainly plays the role of popularizing legal knowledge,cultivating legal thinking and enhancing the concept of rule of law in daily life,and improves the efficiency of rule of law in rural areas.In the process of the overall promotion of the rural revitalization strategy,there are unique opportunities,but there are also certain difficulties.Its predicament mainly shows as follows: the development of "polarization" of organizational form leads to the weakening of autonomy;the backward transformation of the form of etiquette and custom leads to the backward rule of virtue;the prominent formalization of legal form leads to the deficiency of rule of law,etc.The main ways to further enhance the value of rural governance in the new era are as follows: to give full play to the multi-subject participation of rural regulations and conventions,and to consolidate the foundation of rural autonomy;Promote the modernization transformation of the moral education content of township rules and regulations and strengthen the leading role of moral rule;We should combine the rule of law with the construction of township regulations and people’s conventions to lay a solid foundation for the rule of law in rural areas. |
