The Legal Protection Of Chinese Citizens’ Right To Education Is From The Perspective Of Political Examination Of College Entrance Examination

Politics careful college entrance examination system in our country since the founding of new China has been in existence for nearly 72 years,although in the fifties and sixties of the20 th century because of its special "politics careful" deviation bring the s historical memory,but "politics careful" gradually standardized through constant evolution and development,the history of the college entrance examination "said" memory is being gradually forgotten,only2018 cases included in the constitution of China’s top ten one of the "chongqing education released by the university entrance exam politics careful policy" make politics careful system problems surfaced again.Similarly,the "political examination gate",which was selected as one of the top 10 constitutional cases in China in 2009,also concerns the constitutional rights of citizens.The "political trial" of the college entrance examination results in the restriction of citizens’ right to education,so the legitimacy and constitutionality of the "political trial" should be investigated.This article starts from the political review system and the “political review” policy of college admissions by methods of empirical analysis and comparative analysis and Historical analysis to analyze the following issues: First,analyze the impact of the political review system on citizens’ right to education,including the legal basis of legitimacy of political review system and how citizens’ right to education is affected by “political trial”;Second,the political review system and policy issues exposed in constitutional cases,including the analysis of constitutionality of political review system;Third,the emergency ways that because “political trial” affects citizens’ right to education,The result is to protect right to education of college entrance examination candidates from litigation measures,and to explore a new remedy to protect citizens’ right to education(educational public interest litigation),hoping to bring theoretical value and practical significance to improve system of political examination for Chinese college entrance examination.It is concluded that constitutional control should be carried out on the current system of political trial,and on the issue of the right to education of citizens affected by “political trial”,we should seek some solutions from three aspects: legislative perfection,judicial supervision and administrative litigation to effectively avoid similar constitutional examples.
