Research On The Government Supervision System Of PPP Model From The Perspective Of Administrative Law

Since the end of 2013,PPP mode has been widely used in infrastructure construction projects,and the number of applications for PPP projects across the country has been increasing.In view of the characteristics of PPP project,such as long cycle,complex process,professional content and many participants,PPP mode gradually exposed many problems in the operation process.The supervision of PPP projects is an important link to ensure the healthy and orderly development of PPP model,in which government supervision plays an irreplaceable role.First of all,through reading a large number of domestic and foreign literature related to PPP mode,this paper analyzes the basic theoretical knowledge of PPP mode and government supervision system,expounds the concept,characteristics,development process and theoretical basis of government supervision of PPP,and tries to summarize the necessity of government supervision of PPP mode from three aspects: the defects of market behavior,government behavior itself and the operation quality of PPP mode The development of this paper laid a theoretical foundation.Secondly,by sorting out the normative documents such as laws and regulations,this paper sums up the current situation of the development of China’s PPP mode supervision system,analyzes the existing problems from the aspects of supervision subject,supervision content,supervision responsibility and relief,and analyzes the reasons behind the problems.Finally,on the basis of learning from the excellent development experience of foreign government supervision system,from the perspective of administrative law,this paper puts forward suggestions on the construction of the legal system of PPP model government supervision system,the development of supervision subject system,the innovation of supervision content and mode,and the improvement of supervision responsibility and relief mechanism.
