Research On Selective Enforcement Of Grassroots Fishery Administration From The Perspective Of Street-level Bureaucracy Theory

Fishery is an important part of agriculture,while fishery administration is the administrative department that specializes in the implementation,supervision and management of various fishery policies in our country.However,for a long time,social attention has generally been low.Until January 2020,the "Yangtze River Ten-Year Ban on Fishing" caused an uproar on the Internet.The tragedy of the commons still has not been avoided under the fishing ban system,and the selective enforcement of grassroots fishery policies has therefore caused a lively discussion among the public.From the perspective of theory and what it should be,under the strategy of comprehensively promoting the rule of law,it is necessary to eliminate unfair practices in selective enforcement;however,from the perspective of practice and reality,our country also often implements some centralized law enforcement methods,such as crack down,the special law enforcement.But sometimes there may also be some phenomena such as enforcing the law laxly by local governments,different treatment of law enforcement objects,unfair punishments,and even acts of favoritism and rent-seeking,that have repeatedly aroused social debate.Whether the policies formulated by the superior government can achieve the expected results depends on the implementation of the grassroots government.However,some grassroots fishery administrations abused their power to selectively enforce the law in the process of maintaining fishery production,which has greatly reduced the effect of the fishing policies.From the perspective of Street-level Bureaucracy theory,and with the help of the Field theory in social psychology and the BJ Fogg’s Behavior Model in behavioral design,this paper designed a three-level analytical framework Field-Ability / Motivation-Behavior,which is applicable to this article.The main purpose is to grasp the identity attributes of the street bureaucrats of the grassroots fishery administration and place them in specific street areas to study the different law enforcement behaviors in different areas,analyze the reasons and propose solutions.This article takes the Bureau of Fishery Supervision and Law Enforcement of Y County in Hunan Province as an example.Based on a large number of cases,it summarizes the four different law enforcement methods of the grassroots fishery administration in Y County under different fields,and analyzes the influence of the ability and motivation status on action logic in each field,and then put forward improvement suggestions based on the principle of responsibility control of street bureaucrats.An in-depth analysis of the action logic of grassroots fishery administration is not only the basis for an in-depth understanding of Street-level Bureaucracy theory,but also a precondition for optimizing fishery law enforcement.This article hopes to provide a new solution for optimizing the functions of the grassroots government by analyzing the problems in selective enforcement of grassroots fishery administration,so as to promote the effective implementation of the fishery policy.
