| From China’s Reform and Opening Up,China has great achievement of solving women’s employment issue.In 70 years,Chinese Women status has great change,they worked hard to be the owner of the country and their own lives.Therefore,to affirm our achievement,we need to keenly aware that with the development of economy and modern society,the equal employment has the problem which very urgently awaits to be solved.The restrain of women employment is great,women had inevitable obstacles of employment than man,their employment are intimidated.Meanwhile,some outstanding woman are difficult to bring into full play the initiative,wisdom and power of the masses.Women have encountered various difficulty and the challenge in equal employment.Two-child policy add insult to injury.The discriminate against women in employment market is becoming much more serious.The right to labour is given by construction,as a part of it,employment embody the right to labour of economic law.Civil have rights to ask their own country or society to offer them the opportunity of labour.Whether women can get the equal opportunity or treatment of employment relates the achievement of equal.The pressure women faced with,is also the equal right of construction.The definition of equal right are frequently appeal in the law and the treaty of of international law.The rights of equal employment is the extension of equal law.Equal is the core of base right,if we don’t provide the protection of women,human right will lose it’s internal validity.For the above issues,based on the above problems,this paper takes the theory of fairness and justice and the theory of gender equality as the research cornerstone.This study uses a literature analysis,comparative analysis,inductive method,case studies and other research methods to analyses the appearance the restrictive condition of the discriminate against women in employment market,research their employment opportunity,discuss the lost of legal protection and the treaty of women employment.This paper puts forward some prominent problems existing in the system,such as the unequal of employment opportunities,the salary and treatment unequal,the unequal of opportunity for advancement and gender segregation.It is founded that there are some problems in Chinese legal system of equal employment.For example,the identification of discrimination in employment is difficult,the legal standards are not clear,the legislative principle is too strong,the enforceability is not enough,the provisions of burden of proof are unreasonable.Women are difficult to safeguard their employment rights.In view of the above problems,this paper analyzes and summarizes the advanced experience of reducing female employment discrimination in UK and American,puts forward relevant legal suggestions on China employment policies.The anti employment discrimination law should be formulated.Establish the public interest litigation system,the equal employment agency,improve the judicial relief mechanism and solve women’s employment issue. |
