There is a serious phenomenon of gender discrimination in our country.The existence of this phenomenon greatly damages the values of gender equality and is not conducive to the civilization and progress of society.Women are often treated unfairly in a number of ways,including equal pay for women and men,women's "walledness" in gender-based employment,sexual harassment of women in the workplace,and different retirement ages for men and women.Compared with other countries,women in the employment process,the employer for their own economic interests are often under the same conditions,more strokes of male staff and less or not to recruit women.For such discrimination,it is difficult for female victims to seek relief through legal means.This paper will analyze the current situation of gender discrimination in China,including the current situation in China's legislation and judicial practice,so as to explore the shortcomings of China's employment system.And then introduce the legislation and judicial practice of gender discrimination in employment abroad,including the identification of the meaning of sex discrimination in employment,the clarity of judgment criteria,and the identification of gender discrimination in judicial practice,and then on the causes of the relevant consequences To analyze.On this basis,the author puts forward some suggestions to perfect the anti-employment sex discrimination in our country.This paper is divided into four parts:The first part willdefines the concept of gender discrimination in employment.The meaning of gender discrimination is the basis of our judgment and regulation,but through the analysis of the international legislation,the current situation of our country and the study of the theory,we find the shortcomings of the definition of gender discrimination in our country and put forward a more perfect definition.And then,the theoretical basis for the discrimination against sex is mainly based on the theory of equality equality and fairness and justice,which proves the rationality of anti-employment sex discrimination.The second part is the analysis of the current situation of gender discrimination in China,including the enumeration of data and the presentation of typical cases.Data enumeration,mainly based on the People's Congress Court series of reports and the third issue of women's social status report two research reports.In the case list,the case of Zhejiang occurred in the analysis.In addition,this part also combs the legal origins of the legal system of gender discrimination in employment in China.Finally,the author summarizes the status quo of sex discrimination in China.The third part will introduce the legislative experience for gender discrimination in employment abroad.This section introduces the anti-employment sex discrimination in the United States and the United Kingdom,where the legal system is perfect.Which mainly contains the legislative status,basic content and relief of the three major partsThe fourth part is the proposal to improve the sex discrimination in our country.In the first three parts of the article,we have analyzed the present situation and lack of gender discrimination in our country,and also introduced the more complete system of the United States and Britain.On this basis,this part puts forward the corresponding measures to solve the problem of our country.
