Research On Government Regulation Of Shared Economy

The development of shared economy is supported by Internet technology and based on network platform.It is a transaction system of sharing personal idle goods or resources based on trust and the premise that participants’lives are unaffected.Shared economy is an economic form that stimulates economic benefits by activating economic surplus on a large scale.As a business model of universal participation,the threshold of shared economy is much lower than that of traditional industries,which is the corresponding birth of the regulatory issues of shared economy.In the development of shared economy,the platform and individual participants are the objects of supervision,however,the complexity of the type of shared economy leads to a variety of regulators.In the specific direction of supervision,such as credit,tax,insurance,business qualification and employment qualification all have many supervision problems,the traditional regulatory model has not been able to meet the actual regulatory needs.A series of problems in the process of shared economy development have had a significant impact on the government supervision of shared economy,in the process of the gradual rise of the shared economy,a series of social problems have attracted more and more attention.Strengthening the government supervision of the shared economy plays an important role in guiding and regulating the development of the shared economy.Based on this background,this thesisi studies the government supervision in the development of the shared economy.In this thesis,the problems and reasons in the current supervision of the shared economy are analyzed.This thesis points out the problems existing in the current development of shared economy,which are mainly reflected in the inadequate performance of the supervisors’functions,the imperfect basis of supervisory laws and regulations,the unclear industry supervision system,and the imperfect protection measures for users’rights and interests.Through the analysis of the reasons behind it,we can see that the problems in the supervision of shared economy are mainly due to the insufficient supply of government supervision resources,the lag of laws and regulations,the lack of reasonable industry access mechanism,and the game are between platform capital and supervision.In view of the existing problems,this thesis puts forward some corresponding solutions.It points out that government supervision should pay more attention to the clarity of the main responsibility and enhance the effectiveness of government supervision,promote the coordination of supervision among departments,and construct a pluralistic supervision system.From the legal point of view,should strengthen the construction of laws and regulations,and clarify the relevant definitions of powers and obligations.From the aspect of industry supervision,should strengthen the restraint of industry system and establish an access mechanism suitable for the development of shared economy.From the perspective of protecting users’rights and interests,should pay more attention to the establishment of credit mechanism,establish a two-level supervision model between government and platform,platform and users,at the same time pay more attention to preventing excessive capital intervention.Through proposing relevant coping strategies,this thesis hopes to provide some reference for government regulation of shared economy.
