Online car-hailing is based on Internet technology as the means,sharing economy as the business philosophy,"Internet + traditional industry" as an opportunity to create a new way to travel.While enriching the diversity of public travel choices,it invigorates the precipitation resources in the society,improves the utilization rate of existing vehicles,and solves the problem of public travel difficulties.But at the same time,the emergence of online car-hailing has also broken the rules of traditional industries and been opposed by traditional vested interests.Therefore,it is necessary for the government to adjust the way of supervision to harmonize the relationship between subjects and balance the interests between subjects.On July 27,2016,seven ministries and commissions,mainly the Ministry of Transportation,jointly adopted the Interim Measures for the Management of Business Services of Internet-booked Taxis and issued them to the outside world,formally clarified the legal status of online car-hailing,providing legal basis for the survival and development of online car-hailing.However,many problems have been exposed in the process of local governments' supervision of online car-hailing in accordance with the interim measures.Therefore,this paper mainly discusses the problems existing in the process of government regulation of online car-hailing.The first chapter introduces the significance and background of the research on online car-hailing government regulation.Based on the existing literature,the research status of domestic and foreign online car-hailing government regulation is sorted out from three dimensions of economics,law and administration.The second chapter introduces the concepts of sharing economy,online car-hailing and government regulation,and takes the public interest theory,regulatory capture theory,multi-center governance theory and other related administrative theories as the theoretical basis.Online car-hailing is a new industry derived from the sharing economy.It brings convenience to people,but also results in the disorder of the traffic and transport market order in China.Therefore,the government,as a representative of the public interest,must supervise it.However,if the government's regulation of online car-hailing is still modeled on that of traditional taxi,the government is bound to be "captured" by interest groups again,resulting in the same monopoly as the traditional taxi industry.Therefore,the government must change the traditional regulatory thinking and adopt the model ofmulti-subject cooperative regulation to regulate the online car-hailing.The third chapter expounds the current situation of government regulation of online car-hailing,and finds out the problems existing in the subject,mode and laws of government regulation of online car-hailing,and analyzes the underlying reasons.Chapter four studies the regulation path of foreign governments,such as California,London,Singapore,etc.,and summarizes its enlightenment to Chinese government regulation of online car-hailing by referring to the regulatory experience of foreign governments.In the fifth chapter,the author puts forward corresponding solutions to the problems existing in the process of China's online car-hailing supervision.First of all,from the perspective of regulatory subject,the government should change the concept of supervision and introduce the interactive mechanism involving multiple subjects.At the same time,the government should establish a new supervision mode of "Internet + supervision",so as to solve the limitation of the government as a single subject and the inefficiency of multi-department supervision.Secondly,from the perspective of regulatory approach,the government should transfer the regulatory approach of prior approval to the incident and post-event supervision,and try to introduce a flexible spot check regulatory mechanism to establish a two-track credit evaluation system for online car-hailing industry.Finally,in terms of supervision laws,the government should correctly define the legal nature and relevant legal relations of online car-hailing,clarify the responsibility of all parties involved in online car-hailing business and service,and improve the legal system of online car-hailing government supervision.
