| China has always attached great importance to safeguarding people’s livelihood.With the advancement of China’s modernization and population growth,the imbalance between supply and demand of housing has been further increased.The construction of indemnificatory housing has become one of the major focus of Chinese government.However,the development of indemnificatory housing did not goes smoothly and the land supply is the main concern.At present,China’s indemnificatory housing land has insufficient supply,unreasonable location,unreasonable structure,lack of land planning on supporting infrastructure as well as issues on connecting with various types of land docking.The fundamental measure to solve these problems lies in the construction of a systematic legal system of land supply for indemnificatory housing.However,there are many problems in the current legal system of indemnificatory housing land supply in China,mainly in the weak effectiveness of the legal system of indemnificatory housing land supply,the weak legal system of the relationship between the supply of land supply and local fiscal and tax revenue,the lack of the main responsibility and the single supply channel stipulated by the system of indemnificatory housing land supply,and the inability of the existing legal system to mobilize the enthusiasm in investing the indemnificatory housing land.In the construction of a systematic legal system of indemnificatory housing land supply,Beijing,Chongqing and Chengdu have made a preliminary exploration which provides valuable experience for the future.Based on above analysis,this thesis proposes that a unified legal system for the supply of indemnificatory housing land should be constructed from five aspects: constructing a complete and multi-level legal system for indemnificatory housing land supply,regulating the main body of indemnificatory housing land supply and increasing the supply channels according to law,Improving the local fiscal and taxation and indemnificatory housing investment and financing systems,improving the incentive policy for the development of indemnificatory housing land,and establishing a strict supervision system for indemnificatory housing land. |
