Research On Rationalization Interrogation Strategy

The reform of the trial-centered criminal procedure system has put forward more standardized and stringent requirements for the public security trial and evidence collection work,and the traditional intimidating interrogation is difficult to meet the current actual needs.Interrogation and evidence collection is in urgent need of more "soft interrogation methods" in realizing the balance between prosecuting crimes and the protection of human rights.Among them,the Rationalization Interrogation Strategy combines psychology and legal practice,which not only helps to ease the tense relationship between the two sides of the trial and change the suspect’s attitude towards refusing confession,but also helps to ensure the voluntary confession at the same time,to a certain extent,reduce the risk of confessions and false confessions.However,there are still some deficiencies in the research of this method in our country,especially the theory of principle and theme is a little blank,and the effect of its application in practice is not ideal,which needs to be further studied.Based on this,this paper is based on the practice of the current Rationalization Interrogation Strategy,follows the train of thought of the combination of theory and demonstration,and is divided into six parts.The first part is the introduction,which introduces the background and significance of the topic,combs and summarizes the research of Rationalization Strategy at home and abroad,and briefly introduces the research methods and ideas of this paper.The second part is an overview of Rationalization Strategy,on the basis of referring to the existing research,redefines the concept of Rationalization Strategy,analyzes the relationship between Rationalization Strategy and other relevant interrogation strategies and methods,and summarizes the value and limitations of Rationalization Strategy.The third part is the theoretical basis of the Rationalization Strategy.Firstly,it reviews the Rationalization Strategy in principle from the perspectives of cognitive dissonance,compensatory control and social learning,and summarizes the reasons for the suspect’s self-rationalization from the above three perspectives.Then,combined with the existing literature and referring to the classification basis of the suspect’s self-defense by Bandura.The theme of Rationalization is redivided into four categories: beautifying facts,negating norms,externalizing accusations and hiding themselves.The fourth part is the investigation of the current situation of the application of Rationalization Strategy in practice,which adopts the methods of interview and questionnaire,and analyzes and deals with the survey results.In the fifth part,according to the results of the investigation,it is concluded that there are mainly the following problems in the application of Rationalization Interrogation Strategies:First,investigators do not have a strong awareness of the use of Rationalization Strategies;Second,investigators do not have a deep understanding of Rationalization Interrogation Strategies.the specific performance is that the preparation work is not sufficient,the theme connection is not smooth,and the theme is not fully carried out.Third,investigators have improper grasp of Rationalization Strategies and skills,such as lack of euphemism in language,lack of listening and positive appeasement,and the risk of deceiving and seducing confessions.The sixth part,combined with the problems found in the practical investigation and the existing theoretical research results,puts forward the corresponding improvement countermeasures,the first is to clarify the applicable conditions of the Rationalization Strategy,the second is to master the essentials of the use of the Rationalization Strategy,and the third is to regulate illegal temptation.the fourth is to strengthen the communication skills of interrogators.
