A Research On The Investigation Of Criminal Cases Of Black And Evil Forces In Cyberspace

With the deepening of the Crack Down on Gang Crime Campaign,the crimes of black and evil forces began to transform into cyberspace under the attack of the special action.At present,the crimes committed by the evil forces in cyberspace are on the rise,which has become one of the problems endangering people’s life and property safety and social security and stability.To this end,the relevant departments have specially issued the "Opinions on Some Issues Concerning the Handling of Criminal Cases Involving the Use of Information Networks to Carry Out Crimes Committed by the Mafia and Evil Forces" and other guiding documents,emphasizing that efforts should be made to deal with the crimes committed by the Mafia and evil forces in cyberspace,and that they should be included in the task of normalization of the Crack Down on Gang Crime Campaign.In recent years,the crime of the black and evil forces in the real space has gradually transformed into the crime of the online black and evil forces based on the cyberspace after the special action.The black and evil forces taking the cyberspace as the "place" or "tool" of crime show the characteristics of strong concealment,wide involved area,and electronic data as the main evidence.In this new situation,the clue discovery,case characterization,investigation promotion and evidence collection rules of the evil forces in cyberspace have become new problems for the public security organs to solve the cases.Although the detection rate of criminal cases of network evil forces is increasing year by year,in practice,the investigation organs are still faced with many investigation difficulties: firstly,it is difficult to find clues in such cases;secondly,due to the different manifestations of network evil forces in cyberspace,it is difficult for the law enforcement subject to determine the nature of the cases;thirdly,it is because the cyberspace blurs the jurisdiction area and encourages the criminal ability.The criminal capacity of criminal organizations leads to the situation that the investigation organs have "insufficient stamina" and it is difficult to promote the investigation work;finally,the perpetrators rely on information network technology and implement non-contact violations,which makes it difficult to collect and use the evidence timely and effectively.In view of the investigation dilemma of the criminal cases of the black and evil forces,the public security organs should flexibly formulate the investigation countermeasures according to the current situation of the criminal cases of the black and evil forces and the new characteristics of such cases,including the following strategies: first,to actively obtain the clues of the cases and expand the sources of the clues;second,to improve the construction of the legal system and provide clear information for the law enforcement subjects The third is to strengthen the construction of investigation operation ability and improve the whole chain attacking mode;the fourth is to improve the ability of investigators to obtain evidence and establish a complete evidence chain based on electronic data to ensure the effective promotion of follow-up legal procedures.
