Research On The Investigation Countermeasures Of Child Molestation In Cyberspace

Cases of "Child molestation in Cyberspace" refer to the offenders using the Internet as a medium to lure and coerce children into conducting "naked chats" or sending "nude photos" and "nude videos" and other methods of molestation under the guise of "making friends with each other" and "recruiting child stars" for the purpose of sexual stimulation.The crime of "Child molestation in Cyberspace" is a predicate crime of raping or producing,selling,disseminating obscene materials.It is particularly important to do a good job in the investigation and combating of such crimes.It can not only protect children’s physical and mental health,safeguard children’s legitimate rights and interests,but also help to promote the construction of a clean cyberspace.This paper provides investigative suggestions for the public security organs to crack down on cases of "Child molestation in Cyberspace" by analyzing relevant literature,sorting out laws and regulations at home and abroad,and carrying out targeted research in combination with existing relevant cases.According to the judgments published by China Judgments Online and the case materials publicly released by other channels,the number of cases deserves great attention with the continuous development of the Internet.It has caused great harm to the victimized children and their families,and has a bad social impact.It mainly presents the following characteristics: first,the main subjects of the crime is young men with low education level;second,the means of committing the crime are diverse,and the nature of the secondary crime is bad;third,the number of victimized children in the case is large,the geographical distribution is wide,and the protection of their rights is lacking;fourth,the time span of the case is large,and the space for committing the crime is diverse,showing a trend of transnational development.Cases of "Child molestation in Cyberspace" not only need to achieve the goal of investigating and handling general cybercrime cases,but also needs to consider the characteristics of the victim being a child.Therefore,the investigation work has higher requirements than traditional cases.At present,in the investigation and attack of such cases,there are still many difficulties in filing the case,finding clues,investigating and collecting evidence,advancing the investigation,and cooperating in the investigation.In view of these difficulties and in light of the characteristics of the case,the investigative agency should adopt targeted investigative countermeasures: first,focus on the top-level design and unify the understanding of investigation;second,strengthen proactive investigation and broaden the channels for clue discovery;third,focus on online,and excavate multiple types of evidence;fourth,establish and improve investigation agencies for cases involving minors,and improve the professional level of investigations;fifth,base on the whole chain of strikes,and carry out special operations on a regular basis;sixth,strengthen law enforcement linkage and improve case handling efficiency.
