Research On The Legal System Of Alien Species Invasion Prevention And Control In China

The invasion of alien species is the primary reason for the loss of biodiversity and serious damage to the world economy and social interests.At present,the problem of alien species invasion is becoming more and more serious in China,this poses a great threat to the security of ecological environment,economic development and people’s health.The outbreak of New Coronavirus pneumonia in 2019 prompted China to speed up the revision of animal safety legislation and wildlife protection law.The newly promulgated bio safety law also introduced alien species invasion and control into the scope of adjustment,and clearly defined the importance of alien species invasion and prevention in China.The introduction of biosafety law has played a positive role in the prevention and control of alien species in China.However,there are still some problems in the current legal system of alien species invasion prevention and control in China,such as the single alien species list system,the lack of alien species risk assessment system,the need to optimize the alien species inspection and quarantine system,the incompleteness of alien species tracking and monitoring and emergency response system,and the unclear legal accountability system China has many difficulties in preventing and controlling the invasion of alien species.Therefore,our country urgently needs to perfect the alien species invasion prevention and control legal system at present.In this paper,the comparative analysis method and the transdisciplinarity method are used to make specific suggestions on the improvement of China’s legal system for the prevention and control of invasive alien species,it is pointed out that China can improve the list system of exotic species on the basis of analyzing the defects of the existing legal system of prevention and control and drawing lessons from the advanced foreign legal system of prevention and control,and under the guidance of the biological safety law,we should make a reasonable classification of alien species and strengthen the foresightedness and systematicness of the list,improve the risk assessment system of alien species,define the legislative provisions of the risk assessment system of alien species and expand the objects of risk assessment.And the scope of optimization of alien species inspection and Quarantine.System,clear the object and scope of inspection and Quarantine,improve the tracking monitoring and emergency handling system,tracking and monitoring the whole process of alien species in China,and strengthen the ability of emergency handling of alien species after invasion;Clear legal responsibility to investigate the system of alien species.The relevant administrative liability,civil liability and criminal liability of the invasion were further clarified.
