Abstract/Summary:
In the context that COVID-19 may last for a long time,how to protect the employment right of civics in the special period is an unavoidable problem.Therefore,the following three issues should be focused on: first,the existing labor relations should be stabilized as much as possible to reduce the abnormal unemployment caused by the COVID-19;Secondly,for the affected employees that have lost the occupation,the unemployment insurance system should be adopted to ensure their basic living conditions,thus laying a foundation for re-employment;Thirdly,in the context of the general reduction of employment in the special period,the emerging flexible employment mode,such as shared employment,has created a large number of jobs.At this time,it is necessary to carry out effective regulation to safeguard the interests of flexible employment personnel,and at the same time,let the flexible employment mode provide more power to solve the employment problem.According to the above ideas,the problems of the existing legal system of labor employment right protection during the epidemic period can be summarized as the following three aspects: First,the relevant legal system of adjusting labor relations cannot play a role in stabilizing labor relations in the special period;Secondly,the relevant legal system of unemployment insurance can not meet the actual needs of the current period;Thirdly,there is a lack of supporting legal system for the emerging flexible employment model.Under the background of the normalization of epidemic prevention and control,in order to better protect citizens’ right to employment in the special period,it is urgent to improve the relevant legal system: first of all,the specific suggestions for improving and adjusting the legal system of labor relations mainly include the following two aspects: firstly,the major epidemic situation as a special situation is included in the relevant regulations;Second,to improve the legal system of unemployment insurance specific suggestions mainly include the following three aspects: one is to modify the relevant provisions on the conditions of applying for unemployment insurance,expand the coverage of unemployment insurance;Second,according to the characteristics of different unemployed people add special period of insurance subsidy projects;Thirdly,specific suggestions to improve the supporting legal system of the emerging flexible employment model mainly include the following three aspects: first,the introduction of new concepts such as the shared employment and gig economy into the existing relevant laws and regulations;Second,the relevant fundamental issues of the flexible employment should be regulated in the form of law;Third,in light of the actual development of the flexible employment model during the epidemic period,we should formulate some special regulations only applicable to the emergency period.Of course,a short duration of time is not enough for the improvement and perfection of the legal system.When COVID-19 is not over,we should always pay attention to the development of the epidemic and make corresponding adjustments.
