Research On Special Committee System Of Provincial People’s Congress Of China

With the convening of The Fourth Session of the 13 th National People’s Congress,the relevant laws for the construction of The System of PC have been revised,which is involve the content about Special Committees of The NPC’s set up,term of office and job responsibilities.The amendment of the law is of great significance to strengthen the construction of The Special Committee System,improve The Organizational System of The National People’s Congress and The Deliberative System,and develop socialist democracy.Due to the improvement of The Special Committee System of PRC,new requirements are put forward for The Local Special Committee System of PRC.As an internal part of Local People’s Congress,The Special Committee of Provincial People’s Congress is an important organizational foundation to assist and guarantee Local People’s Congress and its Standing Committee to perform their duties.To improve The System of Provincial People’s Congress Special Committee is not only to respond the needs of national system construction,but also to strengthen the work of Local People’s Congress,promote the construction of socialist democracy and the rule of law,and the modernization of local governance system and governance capacity.Therefore,this article will take the Standing Special Committee of Provincial People’s Congress as the research object,take its overall system as the research content,and divide it into four parts to carry out the systematic research on The Special Committee system of Provincial People’s Congress from the internal perspective of the people’s Congress organization.The first part summarizes The System of Provincial People’s Congress Special Committee.Clarify the concept and historical evolution of The Special Committee of Provincial People’s Congress,define the nature of The Special Committee of Provincial People’s Congress accurately and reasonably,and comprehensively summarize the functions of The Special Committee of Provincial People’s Congress in The Local Power Organization structure.The second part is a comparative study of The Special Committee system of Provincial People’s Congress.In the process of organization construction,the organizational structure,personnel structure and relationship structure are compared,in the process of system construction,the provincial local laws and regulations,normative documents and conventions are compared and analyzed.The third part points out the practical dilemma of the operation of The Special Committee system of Provincial People’s Congress currently.There are mainly four aspects:Firstly,the establishment of The Special Committee is not standardized in the organizational structure,and the personnel composition is not reasonable.Secondly,the division of responsibilities and relationship of The Special Committee is not clear.Thirdly,the working mechanism of The Special Committee is lack of superior law,local regulations and other normative documents.Fourth,the legislative function of The Special Committee is insufficient,the supervision power is not fulfilled in place.The fourth part explores the perfect path of The System of The Special Committee of The Provincial People’s Congress.From the aspects of improving the organizational structure of The Special Committee,clarifying the responsibilities and mutual relations of The Special Committee,improve the working mechanism of The Special Committee and enhance the effectiveness of its functions to respond the practical dilemma of the operation of The Provincial People’s Congress Special Committee System and put forward the corresponding countermeasures.
