Abstract/Summary:
The popularity of the Internet has promoted the development of online shopping.By September 2019,the proportion of mobile Internet users in China has reached99.1%.The scale of mobile online shopping users has reached 622 million,and the huge number of shopping drives the continuous prosperity of online shopping market.From the perspective of the operators of the Internet market,it has greatly facilitated online consumers by creating a diversified online shopping platform.But in the process of online shopping,many consumers have been cheated.In view of this,China’s law specifically provides for the right to repent,that is,consumers can make unconditional returns based on the right to repent within the prescribed time.However,China’s provisions on the right to repent are not perfect.The scope of application of the right to repent is not specific.The specific provisions related to the exercise of the right to repent are not perfect.When consumers exercise the right to repent,the rights and obligations of consumers and operators are not clear.And the safeguards for the exercise of the right to repent are not perfect.This paper analyzes the problems of the application of the right to repent in China by means of literature research,comparative analysis and empirical research.In view of the problems existing in China and combined with the judicial practice experience outside the country,this paper defines the applicable scope of the system of the consumer’s right to repent,standardizes the way of exercising the consumer’s right to repent,and clarifies the rights and obligations of both parties in the process of exercising the consumer’s right to repent,and improve the application.
