Study On Power Allocation In The Reform Of Grass-roots Comprehensive Law Enforcement

Comprehensive law enforcement system is a relatively centralized law enforcement force and integrated law enforcement team institutional system established to solve the problem of law enforcement force decentralization and multiple law enforcement leading to mutual prevarication.There are two main forms:one is the comprehensive law enforcement within the department and the other is the comprehensive law enforcement across departments and fields.Grassroots comprehensive law enforcement reform means that in order to centralize and integrate the law enforcement power in various law enforcement fields,centralized comprehensive law enforcement organs are established in practice and the reform of administrative law enforcement in certain fields or certain fields is explored.The practice of comprehensive law enforcement reform varies from place to place,forming the reform model with its own characteristics.Different models also expose different problems existing in the reform,the most prominent problem is in the power allocation of grass-roots comprehensive law enforcement agencies.The scientific allocation of law enforcement power is related to the confirmation of law enforcement subject status of comprehensive law enforcement organs,and defines the scope and boundary of law enforcement activities carried out by comprehensive law enforcement organs.As a part of the whole administrative system,the comprehensive law enforcement organ does not exist in isolation,and its power allocation is directly related to the smooth operation of the state power operationmechanism.Longitudinal,it is necessary to clarify the relationship between the comprehensive law enforcement agencies and the upper and lower administrative agencies,and determine the law enforcement authority of each level of law enforcement agencies.Horizontally,it is necessary to define the scope of powers and responsibilities of comprehensive law enforcement organs and other administrative organs at the same level,so as to realize the integration of powers and responsibilities.Only on the basis of ensuring the smooth exercise of superior and subordinate powers and the reasonable distribution of powers at the same level,can the efficient operation of law enforcement powers be realized and the rights and interests of citizens be protected from infringement in the face of public powers be protected.This paper aims to provide more ideas for further deepening the reform by studying the power allocation problems in the current reform.The full text is divided into five parts.The first part mainly elucidates the related concepts and theories of the comprehensive law enforcement at the grass-roots level.It clarifies the relationship between comprehensive law enforcement,joint law enforcement and relatively centralized administrative punishment power,clarifies the theory of separation of powers and checks and balances,and the theory of administrative simplification and decentralization,so as to provide theoretical support for the reform of comprehensive law enforcement.The second part elaborates the power of the grass-roots comprehensive law enforcement subject.It is clear that as a special administrative law enforcement body,the grass-roots comprehensive law enforcement body has unique characteristics and more abundant power content.In terms of power allocation,there are two ways of distribution,horizontal and vertical,which need great adjustment in the reform.The third part explores the experience of local reform at the grass-roots level.There are some differences in the horizontal and vertical disposition of the power of the grass-roots comprehensive law enforcement subjects in different places.The fourth part analyzes the problems existing in the practice of reform.From the formulation and construction to the actual operation,the lack of legal basis and unreasonable horizontal and vertical allocation of power in various localities have been exposed.The fifth part offers some suggestions to solve the above problems.We will strengthen legislation to provide more legal support for reform,optimize the horizontal and vertical distribution model,and rationalize the power distribution in the comprehensive law enforcement reform at the community level.At the same time,supervision over the exercise of power should be strengthened,and various supervision forces should be mobilized through the combination of internal and external supervision to make the exercise of power more transparent and fair.
