| During the 26 years of unified issuance of sports lottery in China,sports lottery has become a powerful means of financing for the development of sports cause,creating good economic conditions for the development of sports cause in China.However,in the process of sports lottery operation,there are some legal problems: the legislative level is low,the legislative content is vague and so on;In the aspect of management,the self-regulation of administrative subject makes the management efficiency low.In the aspect of cracking down on illegal acts,there are some problems such as unclear definition of the legal responsibility of the subject of responsibility and too light punishment.The reason is that the legal system of sports lottery in China is not perfect enough.Although the State Council formulated the Regulations on Lottery Administration in 2009 and promulgated the Implementation Rules of the Regulations on Lottery Administration in 2012,the thin and general provisions are in urgent need of further improvement to effectively guide practice.Therefore,it is imperative to improve the legal norms related to sports lottery.In this paper,the basic concept and characteristics of sports lottery in the basis of above research,analyzes the development and current situation of the sports lottery related legislation,according to the development of sports lottery,summarize its law the question,moreover has also studied the us and the UK,the three lottery the legal system of developed countries,the issue of the lottery management shall be the responsibility of the local governments,In the UK,lottery is issued by non-governmental organizations authorized by the government,that is,lottery contracting companies.In Japan,the issuance and management of sports lottery is mainly managed by banks.The legal systems of sports lottery under three different modes are different.Finally,by summarizing and comparing the legal norms of sports lottery in different systems and different periods,aiming at some problems in the development of sports lottery in China,China should start from the two aspects of sports lottery management and public welfare protection.We should pay attention to the protection of the independent supervision right of sports lottery management subjects,the strict management of the use of public welfare funds,the standardization of sports lottery issuance procedures and the strengthening of the investigation of the responsibility for the violation of laws and regulations of the lottery.At the same time,we should pay attention to the maintenance of the legitimate rights and interests of lottery users,so as to guarantee the credibility of sports lottery and promote the healthy development of sports lottery in China. |
