While pursuing the transformation of economic development mode,China is also facing several problems, such as severe environmental pollution and heavy economic downward pressure.Nowadays, promoting the upgrading of industrial structure and taking the road of green development with low energy consumption and low pollution have become the key to balancing economic development and environmental protection. The environmental regulation is the main method for the government to control the discharge of pollutants and environmental pollution. While protecting the ecological environment, whether environmental regulation can affect upgrading of China's industrial structure is the central issue studied in this thesis. On the basis of explaining related theories and describing China's environmental regulations, the evolution and status quo of the industrial structure,a mediation effect model and a static panel model are constructed to analyze the three sub-types of environmental regulations: command control, market incentive, public participation,as well as the ways to affect the upgrading of the industrial structure, the linear & non-linear relationship among the three types of environmental regulations and their impact on the upgrading of industrial structure. The results show that: 1.The three types of environmental regulations: i.e.command control, market incentive and public participation can all indirectly affect the upgrading of China's industrial structure through the three paths of consumer demand, technological innovation and foreign trade;2.By studying the linear relationship among these three types of environment and their impact of regulation on the upgrading of China's industrial structure, this thesis finds that the three types of environmental regulations can all promote the upgrading of China's industrial structure, while the promoting effect of the command-control environmental regulation did not pass the significance test;3.By studying the non-linear relationship among the three types of environmental regulations and their impact on the upgrading of China's industrial structure, this thesis finds that the three types of environmental regulations have a U-shaped impact on China's industrial structure upgrading, while the public-participating environmental regulation does not pass the significance test.On the basis of the theoretical analysis and the conclusion of the empirical test, this thesis puts forward several policy suggestions.
