Research On The Negative List System For Agricultural Industry Access

At present,China’s agricultural non-point source pollution is serious.As an innovative system to control agricultural non-point source pollution,the negative list system of agricultural industry access has not been stipulated by law.Based on the central policy documents,the negative list system of agricultural industry access is proposed.Its essence is to prohibit or restrict the agricultural industry that does not meet the requirements of agricultural ecological civilization in the form of list,while the agricultural industry beyond the list is not restricted.This paper first summarizes the legal basis and historical evolution of the negative list system,and then analyzes the legitimacy and feasibility of the negative list of agricultural industry access,including its legitimacy basis and the conflict and coordination between the negative list of agricultural industry access and farmers’ usufructuary rights.The feasibility of the negative list of agricultural industry is clarified,including its value in the prevention and control of agricultural non-point source pollution.Thirdly,the establishment part of the system expounds the system principle,formulation method,formulation subject,formulation procedure and improvement of relevant laws and regulations.Finally,it is the improvement of the implementation mechanism of the negative list system of agricultural industry access,including clarifying the implementation subject of the system,establishing the compensation mechanism,and effective supervision mechanism,and properly handling the relationship between rural agricultural development and rural environmental protection.
