Research On Issues Related To Authorship Of Works Of Art

The right of authorship is an important spiritual right enjoyed by authors.When authors exercise their right to sign works,it not only brings certain spiritual benefits to authors,but also greatly enhances the value of works themselves.This is noticeable for art works.Compared with works without a signature,a work signed by an artist,especially a famous artist,the price difference usually is huge.This phenomenon has attracted some profit-seekers to take risks and commit illegal acts such as forging others' signatures,which has made the art trade market worse,seriously affected the trade safety of art consumers and hindered the healthy development of the art market.In view of this characteristic of art works,this paper focuses on the right of Attribution of fine art works,makes a comparative analysis with other related rights from the nature of the right of Attribution,and puts forward the author's opinions on the relevant legislation and judicature in China combined with typical judicial cases.This paper is divided into two parts: the main body and the conclusion,and the main body includes three chapters.The first chapter mainly uses the historical analysis method,studies the historical development process of the right of Attribution,and tries to explore the essence of the right of Attribution from history and frame the right boundary of the right of Attribution.The second chapter mainly uses the literature research method,combs and summarizes the relevant theories on the basis of the first chapter,clarifies the subject,object,connotation and right attributes of the right of Attribution,and distinguishes it from the right of personal name,the right of name and the right to show the performer's identity.The third chapter mainly uses the case analysis method,combined with the theoretical analysis of the previous two chapters,to make a detailed analysis of the classification of typical cases in China,in order to clarify the gains and losses in practice.Finally,the conclusion part will summarize the full text,self-review and reflect on the shortcomings of the article.
