Research On "Special Section 301 Investigation" Under Sino-US Trade Friction

In the process of the fourth industrial revolution,the trade friction between China and the United States has mainly focused on the competition of high-tech industries between the two countries in recent years.In this context,the United States has repeatedly carried out "Special 301 investigation" on China's intellectual property protection,aiming to crack down on the upgrading of China's high-tech industry,so as to consolidate its leading position in the field of scientific and technological innovation.This paper focuses on the Special 301 survey of the United States under the Sino US trade frictions.First of all,this paper briefly expounds the connotation and origin of "Special 301 investigation",and analyzes the characteristics of American domestic law involved.Taking the intellectual property disputes between China and the United States as the main line,this paper summarizes the general situation and evolution trend of the previous "Special 301 investigation" conducted by the United States to China.This paper focuses on the current situation and essence of this round of trade friction between China and the United States,and expounds the special purpose of the "Special 301 investigation" conducted by the United States against this background.Next,this paper analyzes the multiple internal causes of the "Special 301 investigation" carried out by the United States to China from the two aspects of the trade deficit and the differences in the protection of intellectual property rights between China and the United States,and based on the relevant international laws,emphatically demonstrates its illegality in the WTO system.Then,this paper expounds the impact of the "Special 301 investigation",a violation of international law,on the international multilateral trading system,Sino US economic and trade relations and the "made in China 2025" plan.Finally,in view of the issue of appeal,this paper discusses the solutions of China US consultation,the application of WTO dispute settlement mechanism,the implementation of counter reaction and the promotion of China's intellectual property system construction,and further explores the strategy of China's response to the "Special 301 investigation" of the United States.
