Research On The National Guarantee Of The Right To Sex Education For School-aged Children In My Country

School age is a critical period for children from sexual development to sexual maturity,and it is also an important stage for sexual psychological development.However,the current sexual abuse of children,crimes committed by minors,and frequent incidents of school violence in China are rooted in the lack of comprehensive sexual education for school-age children.Therefore,the research on the right to sexual education of school-age children has become an important link in China.The plasticity of school-age children provides an important opportunity for the country to cultivate good citizens.The sex education of school-age children has certain characteristics.Therefore,the state should give special protection to children's sexual education rights during this period.Helping children to establish the correct concept of equality and self-esteem and personality in school age is a major matter related to citizen training,national development,and social prosperity.It also guarantees the development of civil rights in the Constitution The spirit of realization.This article takes the national guarantee of school-age children's sexual education rights as the research object,and is divided into five chapters for discussion:The first part is the definition of the concept of sexual education right of school-age children.The chapter begins with a legal analysis of the right to sex education.It clarified its relationship with "the right to education","right to health","sex right",etc.,and carried out an innovative interpretation of the concept of the right to sex education for school-age children.This paper expounds the particularity of school-age children's sex education right at the stage and the subject of rights,and finds the core content of school-age children's sex education right.It further emphasizes the practical significance of the state guaranteeing school-age children's sex education right.It is not only conducive to the enrichment and sublimation of modern human rights concepts,but also to the comprehensive promotion of China's current education reform and to the sustainable development of the world.The second part is the constitutional foundation of the national guarantee of the sexual education right of school-age children.This chapter mainly demonstrates the constitutional foundation of the National Institute for the Protection of the Sexual Education Right of School-age Children from two aspects,the theoretical basis of the constitution of state guarantee and the constitutional basis of state guarantee.On the one hand,starting from the theory of State Obligation,according to the basic concept of State Obligation and its functional positioning,it isclear that the right to sexual education of school-age children is an important part of the protection of human rights and human dignity.The spirit of the Constitution holds that,based on the governance of the country's rational law,the state has an obligation to respect and protect the right to sexual education of school-age children.On the other hand,through the analysis of the constitutional text of our country and the origin of international law,we clarify from the perspective of the constitutional text the clear requirements based on the protection of important human rights such as "children's rights","right to health","right to education",etc.The sexual education right of school-age children must be guaranteed by the state.Make a theoretical foundation for future development.The third part is the extraterritorial experience of the national guarantee of the right to sexual education for school-age children.This chapter analyzes and sorts out the practical experience of the national guarantee of the right to sexual education for school-age children outside the country,and summarizes three different models: "school sex education model","family sex education model" and "comprehensive sex education model".The national guarantee of the right to sexual education of school-age children provides corresponding practical experience and a new dimensionality of thinking: clear legislation first,focus on domestic actual needs,achieve full coverage of needs and overall phased integration,do not stick to scientific knowledge of sexual health,and value sexual moral rights Taking value education as the mainstream is an important way to construct a sexual education rights guarantee system in China.The fourth part analyzes the status quo of national security of school-age children's right to sex education.This chapter starts with the status quo of the formulation of policies and laws for school-age children's sex education in China,school teaching practices,and state-owned linkage measures.Among them,policies and laws have related regulations,whether national or local.In the state of free development of schools,the effectiveness of the state's linkage measures is obviously limited.Through three macro analysis,in order to put forward more targeted suggestions for the improvement of the fifth part of the guarantee mechanism.The fifth part,the national guarantee mechanism of school-age children's right to sex education is perfect.Based on the analysis of the status quo in the previous chapter,this chapter finds that there are two obvious deficiencies in the protection of school-age children's sexual education rights in China,including incomplete policies and laws,and insufficient national safeguards.In response to such shortcomings,three suggestions for improving the national security mechanism are given: first,establishing the basic principles of national security(theprinciple of maximizing children's rights,the principle of comprehensive pluralism,and the principle of practical feasibility);secondly,in terms of legal policy basis Make improvements,urge the amendment and improvement of various laws,and grasp local implementation;third,further refine the system procedures,focusing on the school's refinement of the sex education system for school-age children,and implement the country's guidance to schools to achieve The state's guarantee of sex education for school-age children.
