Children are developing people.They have many characteristics of human beings,but they lack the judgment of a rational person.Therefore,children are difficult to make decisions that are most conducive to their own development based on their own ideas.They are in a weak position in the whole social life and need the joint efforts of family,society and country to guarantee the maximum rights and interests of children.People need to be shaped or taught on campus in order to acquire the skills to achieve all their goals.Children's growth can not be separated from the guidance of education.In the process of children's receiving preschool education,because of the long-term existence of three kinds of predicaments: internal predicaments,external predicaments and mixed predicaments,it is difficult for children's preschool education rights in predicament to be realized smoothly.The research on the guarantee of the right to receive education of children in difficulties not only needs to study the guarantee policies of children in difficulties at this stage by combing the development process of China's preschool education,but also needs to focus on the existing laws and regulations of children in difficulties preschool education and find out the existing problems.On the basis of combing the existing policies and regulations,this paper finds that there are many problems in the current policies and laws of preschool education for children in difficulties in China: the early start of preschool education for children in difficulties in China,the government's policies for the protection of preschool education rights for children in difficulties: the implementation of the main responsibility is unclear;the total amount of financial investment is insufficient and the structure is not clear in the financial policies Unreasonable;the pre-school education policy fair guarantee is insufficient and so on.In China,there are some problems in the legislative protection of preschool education for children in difficulties,such as low level of legislative protection,unclear rights and obligations,and different levels of local preschool education legislation.Since the founding of the people's Republic of China,the development of pre-school education policies and regulations has gone through seven stages.Now it is in a leap forward development stage.Through increasing financial investment,establishing a reasonable pre-school education cost sharing mechanism,encouraging private capital to enter the pre-school education,and expanding the supply of universal pre-school education resources,the government implements the pre-school education security work for children in difficulties.In order to better protect the rights of children in difficulties in preschool education,it is necessary to use appropriate theories to analyze the problems existing in the policies and legislation of preschool education of children in difficulties in China on the basis of the study of the protection process of the rights of children in difficulties.Specifically,to protect the rights of children in difficulties in preschool education,we should at least clarify the relevant concepts of children in difficulties,establish a system to guarantee the rights of children in difficulties,and expand the scope of preschool education policies and laws.Based on the experience of other countries and regions in the world,this paper analyzes the feasibility and necessity of incorporating one-year preschool education into the compulsory education system in China,and puts forward that one-year preschool education should be incorporated into the compulsory education system in a step-by-step and special way to protect the rights and interests of every child's preschool education.In view of the lack of research on the legal responsibility of the main body in the guarantee of children's pre-school education,this paper makes an additional elaboration on the part of clarifying the legal responsibility of the government,pre-school institutions and other individual organizations in the stage of children's pre-school education.It is the fundamental purpose of national development to improve the well-being of people's livelihood.To protect the right of preschool education for children in difficulties is the guarantee of the legitimate interests and demands of vulnerable subjects.In the long run,it is conducive to improving the comprehensive quality of the people and the international competitiveness of the country.At present,China's legal system reform has entered the deep-water area,and the formulation of policies and laws has progressed in the direction of refinement and specialization.The protection of children's rights to education in difficulties is increasingly institutionalized and systematized.In the future,the promulgation of preschool education laws and more policies on preschool education for children in difficulties will become an important institutional guarantee for the national education.
