Administrative law enforcement civil servants are an important part of the civil service team,the smooth implementation of administrative law enforcement work is inseparable from the administrative law enforcement personnel to give play to their subjective initiative,and actively and strictly in accordance with the provisions of laws and administrative regulations according to the law administration.In recent years,the problems of administrative law enforcement personnel in the process of law enforcement have become common.In law enforcement,there are such phenomena as inaction,negligence and even disorder of law enforcement personnel,which lead to social conflicts and damage the good image of the country,government and civil servants.It can not be ignored that the lack of incentive mechanism is an important factor causing this problem.On the one hand,we should look at the needs of civil servants of administrative law enforcement objectively,guide and meet their needs reasonably,and encourage them to take active actions.On the other hand,the administrative law enforcement civil servants should be punished to a certain extent for their inaction,so as to play an effective deterrent effect speaking at the fourth meeting of the state council on the work of clean government,said that while holding law enforcement officials accountable,we should also improve the incentive mechanism so that the competent,the weak and the weak can be eliminated.Therefore,it is necessary to introduce the incentive mechanism into the process of law enforcement and study the incentive system of administrative law enforcement.The ultimate direction of the incentive system for civil servants of administrative law enforcement is to motivate law enforcement personnel to strictly enforce the law and administer according to law from positive and negative aspects,so as to promote the active actions of administrative law enforcement personnel and improve the efficiency of law enforcement.Perfect the incentive system of administrative law enforcement,on the one hand,actively encourage law enforcement officers law enforcement,administration according to law,effectively improve administrative law enforcement class civil servants working environment,improve work enthusiasm,improve work efficiency,on the other hand,in violation of legal procedure of law enforcement personnel punishment effect,in violation of legal procedure of law enforcement officers and other law enforcement officers warning effect,achieve the wake-up call,to ensure that the administrative law enforcement work in legal and efficient in orbit.At present,the legal definition of civil servants of administrative law enforcement in China is just clear,and the exploration of their incentive system is still in the preliminary stage,lacking of systematic quantitative research.Focuses on the positive and negative incentive system from the Angle of principle,the existing administrative law enforcement of the incentive system is mostly referring to special law,and no incentive system for law enforcement system,because of the comprehensive law enforcement of civil servants and the administrative law enforcement class civil servants the reality of difference,the incentive mechanism of some special law in the applicable even contradiction.In practice,it is very difficult to operate.If the incentive system is not perfected,it will lead to more and more serious problems and form a vicious circle,which will cause great obstacles to the smooth implementation of administrative law enforcement and harm the good image of law enforcement subjects in the public mind.Taking the incentive mechanism of civil servants of administrative law enforcement in Shanghai as the research sample,this paper tries to open up a new perspective,explore the incentive mechanism construction of civil servants of administrative law enforcement,further enrich the incentive methods of civil servants of administrative law enforcement,and provide some references for further improving the incentive mechanism of civil servants of administrative law enforcement.
