In the Third Plenary Session of the 18 th CPC Central Committee,the decision of the CPC Central Committee on several major issues of comprehensively deepening reform proposed to "ordinar establish the government legal adviser system".In the Fourth Plenary Session of the 18 th CPC Central Committee,it was further clarified that"actively implement the government legal adviser system,establish a legal adviser team with government legal personnel as the main body and experts and lawyers as the participants,so as to ensure that legal advisers can work in the formulation of major business plans The government legal adviser is not a new thing,but put forward higher standards for the system after the Fourth Plenary Session of the 18 th CPC Central Committee.It originated from European and American countries,and then developed in China.Now in the construction of rule of law government in China,it has become an important force to further the government's administration according to law.Nevertheless,inreality the implementation of the system is not ideal,and it does not adapt to the goal of promoting administration according to law in terms of imperfect selection system,management system and security system.There are many reasons for these problems,which may be caused by traditional concepts and lack of legal protection.Based on the theory of government legal adviser system,this paper expounds the function and value of government legal adviser.On the basis of analyzing the current situation of the development of government legal adviser in our country,this paper reviews and conceives the development experience of foreign countries and Hong Kong,and puts forward some suggestions on legislation,safeguard mechanism and improving the appointment process It will be of practical significance and academic value to deepen and promote the development of the government legal adviser system under the background of the construction of the rule of law government...
