Research On Administrative Law Enforcement Problems And Countermeasures Of Tobacco Monopoly In Yunnan Province

China is the largest tobacco producer and consumer in the world,and Yunnan is the largest tobacco and cigarette production base in China.Tobacco plays an important role both in the national economy and in the local economic and social development of Yunnan Province.Because of the particularity of tobacco,our country implements the monopoly system and brings the tobacco monopoly management into the national administrative law enforcement system.As an important part of the monopoly system,tobacco monopoly administrative law enforcement is a sharp weapon to safeguard national interests and consumers' rights and interests.An antidote against the disease is hitherto unknown.However,with China's entry into WTO,the pace of tobacco control and the rapid development of e-commerce and logistics industry under the background of "Internet plus",the tobacco industry is facing unprecedented pressure.The tobacco monopoly administration law enforcement work also exposes many problems.It is urgent to find the cause and suit the remedy to the case,to change pressure into motive force,and to find new opportunities in crisis.This is not only an inevitable requirement for the in-depth implementation of the spirit of the 19 th CPC National Congress and the 4th Plenary Session of the 19 th CPC Central Committee,but also the objective need to continue to maintain the vitality of the tobacco monopoly management system and fully release the dividends of the monopoly management system.In this article,Yunnan tobacco monopoly administrative law enforcement as the research object,combined with the author's many years of work experience in the province,city,County Tobacco Monopoly Bureau,using literature research,field investigation,case analysis and other methods,the tobacco monopoly administrative law enforcement problems and Countermeasures in Yunnan Province were studied.The article is divided into 5 chapters.Chapter 1 is the introduction,briefly introducing the background and significance of the research,the status quo of research at home and abroad,the content of the research,ideas and methods,innovations and deficiencies;Chapter 2,introduces related concepts such as tobacco and tobacco monopoly products,tobacco monopoly,administrative law enforcement,and the theoretical basis of this article;Chapters 3,4,and 5 are the key content of this article.According to the current situation investigation-raising questions-analyzing problems-solving the overall structure of the problem,in-depth analysis of Yunnan Province The current status of administrative enforcement of tobacco monopoly,the existing problems and the causes of the problems,and the improvement countermeasures and suggestions from six aspects.In the research,the author found that the administrative law enforcement of tobacco monopoly in Yunnan Province not only has some common problems of the national tobacco monopoly management,but also has its own unique personality characteristics.For example,Yunnan is located in the southwestern border of my country,and the phenomenon of smuggling tobacco and cigarettes at the border is more prominent,which places high demands on the border joint prevention and control and cross-border joint law enforcement mechanisms;in addition,Yunnan is the province with the largest number of ethnic minorities in my country,and has a considerable number of cigarette retailers.Both tobacco farmers and tobacco planters are ethnic minorities,which to a certain extent increases the difficulty of administrative enforcement of tobacco monopoly.Therefore,the author hopes that the research results of this article will have certain guiding significance for improving the quality and level of administrative enforcement of tobacco monopoly in Yunnan Province,and can also generate certain reference value for administrative enforcement of tobacco monopoly in other provinces.
