Research On The Legal Aid System For Juvenile Victims

Legal aid has a long history in the world,among which the legal aid system for minor victims also gradually emerges and develops with the development of the times and the progress of humanities.The legal aid system of juvenile victims refers to that the state,taking into account various disadvantages existing in minors,is difficult to get help in time,protect their physical and mental health and protect their rights when they suffer from various types of illegal infringement,so as to help the minor victims fully participate in their own maintenance through the legal aid system In the activity of power,a system to compensate for the unfair caused by the age of both parties.The perfection of legal aid system is of great social significance to China in the transition period.But there are still some deficiencies in the legal aid system of juvenile victims in China.Therefore,it is an urgent task for China to improve the legal aid system for juvenile victims in China.Based on the analysis of the existing theories and practices of the legal aid system for minor victims,this paper finds out the deficiency of the system as far as possible,and puts forward some measures and suggestions to make up for the deficiency.First,the author introduces the existing problems of the legal aid system of minor victims,such as inadequate legal provisions,imperfect procedures and insufficient legal aid practice.The causes of the existing problems are analyzed through legislation,institutions,personnel,funds and supervision.Through the introduction of the causes and the problems,and combining the practice of Ningbo and Beijing in Zhejiang Province,the loopholes in the legal aid system of juvenile victims in China are found out,and the loopholes can be made up and corrected.Secondly,from the new law of China,combining the local legal norms of Tianjin,Jiangxi,Shanxi,Beijing and other places and the author's experience in practice,the paper analyzes the existing foundation and necessary conditions for the construction of legal aid system for minors.With the rapid development of China's economy in recent years,in the more developed areas,the economic development has led to the progress of law.Judicial practice in Zhejiang,Beijing and other places has set up a good example for us.Finally,combined with the working experience of advanced areas,the author further proposes suggestions to strengthen the legal aid system construction of juvenile victims,improve the operational procedures of the legal aid system for minors in China,and improve the current situation of the legal aid practice of minors in China.The author analyzes the existing problems of this system in China and puts forward countermeasures in combination with advanced practice methods,hoping to help the legal aid of the minor victims in the future.
